Pursuant to the Indiana Access to Public Records Act, I hereby request the following records:

Records related to current bulk fuel contracts (Gasoline, Diesel Fuel). Documents would include; original RFP, Amendments, Bid Tabulations, Volumes, and Awards.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

We have again reviewed your request for public records and have determined the same is not suitable for release of records.

The Indiana Access to Public Records act provides in part:

IC 5-14-3-3
Right to inspect and copy public agency records; electronic data storage; use of information for commercial purposes; contracts

"...may not use the information for commercial purposes, including to sell, advertise, or solicit the purchase of merchandise, goods, or services, or sell, loan, give away, or otherwise deliver the information obtained by the request to any other person for these purposes."

Our review of your communication and of your company website clearly indicates that your intended use of the records which you have requested are for "commercial purposes". For this reason your request is denied as inappropriate for disclosure.
