To Whom It May Concern:
Pursuant to the Iowa Open Records Law, I hereby request the following records:
1) All reports regarding Work Opportunity Tax Credits certified in 2019 and 2020 provided to the US Department of Labor, including forms 9058.
2) Any database tracking Work Opportunity Tax Credit certifications which is created or maintained by your department or by any third party vendor under contract with your department, preferably in .csv or .xlsx format. If it is easier, the database can be limited to the calendar or fiscal years ending in 2018, 2019 and 2020.
3) The most recent of any contracts with third party vendors to track WOTC certifications.
My goal is to ascertain which businesses and industries are applying for and/or receiving Work Opportunity Tax Credits, for which categories of employees and which occupations. If a conversation could help narrow or expedite the completion of this request, I am available at 802 233 4992 and emily_corwin@harvard.edu.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you for this. While I understand USDOL has been suggesting that states reply as you have, their performance reports are not an adequate substitute for the records I have requested. For one, they don’t contain the information I am seeking at the state level: wage information and job position information. Additionally, the existence of a related report in the custody of a federal agency is not a valid reason why Iowa should be exempt from disclosing records in its custody. If you believe the records I have requested are exempt from Iowa Public Records Law, please cite the relevant exemption.
As for item #2: I am not seeking fiscal expenditure data. Rather, I am seeking fields from the database Iowa uses to tracking Work Opportunity Tax Credit certification applications. Any fiscal expenditures associated with WOTC would a) not be contained in this database and b) be expenditures made by US Congress via the IRS, and are not subject to Iowa state law.
Let me provide you with more information about what I am seeking. I am seeking records from the database your department uses to populate DOL ETA form 9058 – a database likely created from the information you receive from businesses on DOL ETA form 9061 and 9062. These forms are used by the state of Iowa to certify businesses’ eligibility for a tax credit they may or may not later file for with the IRS. (This data is not tax data, as your office does not submit it to the IRS, but rather to USDOL. The information I am seeking is also not PII as defined by OMB and USDOL. If you are unsure about this, I encourage you to reach out to the national WOTC office).
In particular, I am seeking the following fields for the years 2018, 2019 and 2020 in .csv or .xlsx format:
