To Whom It May Concern:
Pursuant to the Colorado Open Records Act, I hereby request the following records:
I am submitting a Colorado Open Records Act (CORA) request seeking access to specific documents related to your department's activities for the 180 day period preceding today, from Friday, February 9, 2024, to Wednesday, August 7, 2024. Specifically, I am requesting:

2. All records of CORA responses issued by your department in response to external requests within the same timeframe.
3. A copy of the fee schedule for processing CORA requests and any associated costs.
4. A copy of your department's open records policy for reference.
5.Correspondence in relationship to CORA requests sent between government entities.
Please include details such as dates, requestors' names, and request contents in the CORA records.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.
Sincerely,
Samuel Newton

You've never received a CORA request?
Could I expand the search to March 2020?
From: Jefferson County Sheriffs Office
Good Morning,
We do not follow CORA statutes. We fall under CCJRA statutes. If you would like to make a request regarding CCJRA, you will need to complete the attached form.
Thank you,

The request would include CJRA records.
As well as documents that by themselves are available as CORA records.
Including any and all requests to the records department(s) by individuals, attorneys, news organizations and outside government entities.
An example would be a traffic incident report request.
Emails or text messages requested by a local news station.
Case Reports pulled via attorneys (with redactions in necessary).
Requests directed towards your office originating from the County Clerks office.
Sometimes the County Clerk will handle the request.
Could you provide the complete Jefferson County Sheriff's policy that includes maintenance of records?
From: Samuel Newton
Thank you for your previous responses regarding my Colorado Open Records Act (CORA) request. I appreciate your assistance and attention to this matter.
To ensure that we are in full compliance with the legal requirements of CORA, I respectfully request that you provide the specific statute or legal citation that mandates the use of a formal request form for submitting a CORA request. My understanding is that a written request should suffice under CORA, and I would like to verify if there is any statutory basis for the necessity of a specific form.
Your prompt response with this information would be greatly appreciated, as it will enable me to proceed accordingly with my request.
Thank you for your cooperation.

Hello,
The Jefferson County Sheriff’s Office is a criminal justice agency governed by the CCJRA. The CCJRA requires criminal justice agencies to maintain records of “official actions” directly relating to the course of their public safety duties. See C.R.S. § 24-72-301(2).
The Colorado Open Records Act (CORA) requires that records created and kept by a public-financed entity be open to public inspection, with limited exceptions. See C.R.S. § 24-72-201.
Also, by Colorado law, the pecuniary statement has to be signed.

Could you provide the complete Jefferson County Sheriff's policy that includes maintenance and release of records?
Usually there is mention of CORA and CJRA records.
You're expecting a pecuniary statement to be needed on the request?
You've never received a CORA request?
From: Samuel Newton
Attached is an example of Policy from a local police department.
Do you have similar Policy for the Sheriff?

I wanted to respond to your inquiry below. The Colorado Criminal Justice Records Act (the "CCJRA") defines the Sheriff's Office as a criminal justice agency. As a result, the CCJRA governs all requests for Sheriff's Office records. Unlike CORA, the CCJRA requires the statutory attestation outlined in CRS 24-72-305.5(1). You can either fill out the Sheriff's Office form, which I attach as a courtesy, or simply provide a statutorily compliant signed statement. Yes, the pecuniary attestation is required by Colorado law.
Due to the sensitive nature and unique circumstances surrounding law enforcement records, the CCJRA statute is a branch-off of the CORA statute and provides further direction for the management and release of criminal justice records. Requests are processed with CCJRA compliance in mind, but I believe your request below is referencing the spirit of public records in general. Please confirm the intent of your request.
Each law enforcement agency has their own procedure and expectation surrounding their agency records. Generally, you will see the CCJRA statutes 24-72-301 et seq. referenced in all Colorado law enforcement communications, as the above snapshots and Jefferson County Sheriff application reference.
Be advised that a $20/hour fee will be assessed if the request takes over an hour to complete. Due to the volume of Sheriff requests received on a monthly basis and resulting communications, further clarification of items #1, #2, and #5 with more specific parameters it will aid in the responsiveness of your request.
Thank you,
Mary

Seth,
Items 1-4 are ready for delivery. I will send them over through Sharepoint.
Our agency practice is not to open or upload to external links.
You will get a separate email to access the records. In the meantime, please provide a more narrow parameter for those emails and I will work with our IT.
Thank you,
Mary
