Pursuant to the The Kansas Open Records Act, I hereby request the following records:

I am requesting copies of public records regarding the public funding of commercial drivers' license training programs from 01/01/2018 to 12/31/2022. These programs are designed to prepare students to meet the qualifications to become a qualified entry-level commercial truck driver. Funds for these programs were made available through the Workforce Innovation and Opportunity Act.

Specifically, I request information regarding the following:
- Budget documents for the full date range noted above, including planning documents, proposals, and research reports
- Spending reports
- Communications, including internal emails, press releases, and meeting notes and transcripts, that include the phrase "commercial drivers' license"

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

KDOT typically does not assess costs for requests which can be handled with a minimal amount of staff time. However, depending upon the number of documents requested and the amount of time involved in collecting those, significant staff time may be required to research, compile, review and make the requested records available. KDOT is authorized to assess such costs to the requester under the Kansas Open Records Act, specifically, K.S.A. 45-218 and 45-219. The Kansas Department of Transportation (KDOT) has received your KORA request and you should have received an acknowledgement and tracking number. We are unable to move forward with your request until we receive some clarification from you.

Are you requesting specifically ONLY any documents related to the Workforce Innovation and Opportunity Act? If that is the case, then we should be able to respond simply and quickly, with no fee.

If you are requesting ALL documents related to funding of commercial driver’s license training programs, emails, press releases, meeting notes, and transcripts that include the phrase “commercial driver’s license” from 1/1/2018 to 12/31/2022, then that requires a much broader response. Please understand there could be hundreds of thousands of responsive records within our agency related to “commercial drivers license”. Many of which would be withheld due to HR or legal reasons. If this is what you are requesting, then this would require a significate amount of time to collect the documents and substantial fees would be applied. At this time, I cannot provide an estimate of time or fees, as many staff and bureaus within KDOT would have to gather the information.

I am following up on my request for clarification of your Open Records Request since I have not heard from you. The Kansas Department of Transportation (KDOT) has not received or used any Workforce Innovation and Opportunity Act funds for commercial drivers' license training programs from 01/01/2018 to 12/31/2022. There are no Communications, including internal emails, press releases, and meeting notes and transcripts, that include the phrase "commercial drivers' license" as related to the Workforce Innovation and Opportunity Act.

KDOT does have internal communications regarding “commercial drivers’ license” unrelated to the Workforce Innovation and Opportunity Act during the time from 01/01/2018 to 12/21/2022. Those emails would number in the thousands and would take time to gather, and fees would be assessed for the staff time to collect them. Please advise at your earliest convenience if you would like to move forward and have us collect that email. If the information above satisfies you request, please let me know so I can close the request.

It was a pleasure speaking with you on the phone this morning regarding your request. As I mentioned KDOT uses general funds to reimburse employees for CDL licensing but has nothing to do with statewide Commercial Drivers License training. As I suggested, the Kansas Corporation Commission and The Kanas Department of Revenue may have more useful information. I am providing the following links for your convenience.
