Pursuant to the Kentucky Open Records Act, I hereby request the following records:

I write to request access to and a copy of your record request logs from January 2019 to the present in their native electronic format, ideally in Excel or a similar structured tab-delimited text file. Please include all fields of the database, including date of request, name of requester, organization of requester, contact information, a description of what was requested, date completed, disposition (e.g., denied, fulfilled in full), any copy fees charged, and any other fields not exempt by law. If fields are redacted, please note the legal reason. These logs are extremely important to help us better understand the nature of repetitive, vexatious and unduly burdensome requests for our study in trying to find solutions for agencies in dealing with such requests.

If your agency does not maintain these public records, please let me know who does and include the proper custodian's name and address.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Dear Ms. Rillo,

On Wednesday, November 13, 2024, the Kentucky State Board of Elections (“SBE”) received your email requesting “a copy of your record request logs from January 2019 to the present.”

Your request asks SBE to interpret what is meant by “record request logs,” as SBE has no record labeled as such. Under the Kentucky Open Records Act, a requesting party must identify the specific documents sought and a request that does not describe the records sought with specificity need not be granted.

If you would like to make a request for specifically described records, please feel free to do so.

This response adequately and sufficiently complies with your request, the Kentucky Open Records Act, and constitutes final action by the Kentucky State Board of Elections.

Hello,

Thank you for responding to my public records request. I fully understand the miscommunication we seem to be having.

To be clear, I am requesting to know what public records requests the elections department has received since 2019. For example, other offices have exported their internal living document that they use to keep records of the requests their offices receive. These files have been sent with the following fields included: date of request, name of requester, records requested, status of request, etc.

I am requesting a copy of a similar document of the same nature.

How does your office keep track of what requests you receive? How do you update the status of those requests as your office processes the request? I am seeking records that reflect the answers to these questions pertaining to record requests since 2019.

Please let me know if you have any other questions or concerns regarding completing my records request.

We do not have a document that tracks date of request, name of requester, records requested, status of request, etc.

I'm not sure if your are looking for records to compare processes state-to-state, so I'm not sure if this helps or not, but at the Kentucky State Board of Elections, an open records request is either sent to me or forwarded to me, I take note of that date, count five business days, note that date is when the response is due, and then collect whatever records may be required. It is a pretty low-tech system with no living document that tracks anything.

Out of curiosity, where do you note the date and name of requester? That's really all the information I'm seeking. For example, I've attached records I've collected from Gwinnett County, GA. This is the type of information I am trying to collect for the study I'm working on.
