Ms. Scutchfield --
To clarify, is the assertion that there are no responsive records based on (1) their electronic format; or (2) their possession by Facebook, Twitter, or Instagram?
With respect to the former, Kentucky's public records laws broadly grant access to information "regardless of physical form or characteristics," including electronic information. With respect to the latter, the law provides access to information "prepared, owned, used, in the possession of or retained by" the agency. The settings for the various accounts operated by the Secretary of State (see, for example, https://www.facebook.com/KySecofState, https://twitter.com/KYSecState) were set (that is, prepared) by the Secretary of State. These records may be accessed at any given time by the agency (that is, they are currently being "used" and are in the "possession" of the agency), as evidenced by the frequent and regular posts on those accounts. Indeed, even as I write this, the Secretary of State is currently tweeting: https://twitter.com/KYSecState/status/1500857516091187203.
Given the foregoing, I respectfully request that you reconsider the denial of access.
Best,
Adam Steinbaugh
