To Whom It May Concern:
Pursuant to the Kentucky Open Records Act, I hereby request the following records:
All 2019 and 2020 reports regarding Work Opportunity Tax Credits and certifications submitted to the United States Department of Labor, including forms 9058.
It is my understanding that these forms are submitted quarterly and contribute to US DOL's "Performance" website (https://www.dol.gov/agencies/eta/wotc/performance#nat-tax-cert). My intention is to ascertain with as much detail as possible which Kentucky industries, businesses and/or occupations are being certified for WOTCs. If I can assist in the narrowing of this request, please give me a call: 802 233 4992.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Hi Megan,
Thank you for the prompt response. I just left you a voicemail -- I want to make sure I understand exactly what the case is with these records.
First, I want to confirm that I have the right state agency to begin with. It is Education Workforce & Development that prepares the quarterly WOTC reports required by USDOL, correct?
Second, seeing as the State of Kentucky is required to submit quarterly reports to USDOL regarding its WOTC certifications, am I to understand from this denial that the state does not keep a record or copy of these reports, once submitted?

Good morning Emily, sorry I missed your call yesterday. To answer your questions, yes you have contacted the correct office. However, the Education and Workforce Development Cabinet, Department of Workforce Investment, Office of Employer and Apprenticeship Services (OEAS) administers the WOTC program in Kentucky. OEAS provides US DOL with data for the WOTC reports through a US DOL online portal. US DOL reviews and certifies the data, and then places it on the ETA Form 9058. US DOL is the custodian of those reports, and thus in compliance with the Kentucky Open Records Act, you have been provided with the name and contact information for the custodian of the requested records.
