Pursuant to the California Public Records Act, I hereby request the following records:

Copies of all reports, lists, databases, or individual documents created since 1/1/16 detail lawsuits brought against the city's police department. This should include any documentation mechanism your department uses to track lawsuits. It should also include any documents your department submits to local, state, or federal agencies listing the number and/or status of lawsuits brought against the police department.

This request should be construed to include documents compiled quarterly, annually, or in other increments as well as documents or databases that contain responsive information over a longer time span.

Please provide all available materials from January 1, 2016 through November 6, 2024.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I'd like to clarify with you: we don't represent the Bakersfield Police Department, that CPRA would be directed to the City of Bakersfield. Did you mean this to be directed to the Kern County Sheriff's office for sheriff records?

Thank you for that clarification.

This e mail is in response to your CPRA, regarding sheriff records, sent electronically on 11/6/24 to our County Counsel at mraison@kerncounty.com. This request asked for police records. I e mailed you on 11/18 asking if you meant to request sheriff records, as we do not represent the police department. You responded on 11/19 that yes, you meant sheriff records.

The County is unable to fully respond to your request within the 10-day statutory time period. Due to the following “unusual circumstances,” the County will need additional time as provided by California Government Code section 7922.535:
(1) The need to search for and collect the requested records from field facilities or other establishments that are separate from the office processing the request.
(2) The need to search for, collect, and appropriately examine a voluminous amount of separate and distinct records that are demanded in a single request.
(3) The need for consultation, which shall be conducted with all practicable speed, among two or more components of the agency having substantial subject matter interest therein.
I will respond to your requests further by December5 , 2024.

This is an update to my previous letter to you. County staff have consulted in relation to your request and have begun to search for the requested records. The County will need additional time as provided by California Government Code section 7922.535 due to the following “unusual circumstances:”
