Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:
Records showing the proposed floorplan, cost, and related information for the Center for Leadership and Ethics Phase II, described as "this 66,144 square foot facility will bring together portions of the Leadership Development Program and the VMI Museum in a new facility,
allowing opportunities to share resources, collaborate on programming, and grow the VMI leadership development experience for leaders at all levels with focus on the Corps of Cadets. The facility will include classrooms and auditorium, group collaboration areas, museum display spaces, interactive learning venues, storage space, office space, catering space, and general support spaces." To include, without limitation the space and square footage allocated to the VMI museum and the planned utilization of the parking garage (staff, faculty, cadets, public, etc. If cadets, how many parking spaces are allocated to them.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

After consultation with the individuals responsible for the information you requested, I have determined that the estimated cost of fulfilling your request is $77.96. As you may be aware, § 2.2-3704. F. of the Code of Virginia allows public bodies to charge for accessing, duplicating, supplying, redacting or searching for the requested records. This estimate reflects one hour of the construction director's time at an hourly rate of $77.96. This does not include any printing or mailing costs, if applicable.

What precisely is the labor involved in this request? What is the "search" required? Why will it take the construction director an HOUR to locate this record?
As I am sure you are aware, the CLE II effort is the focus of a very large and very public funding debate, with Gov. Youngkin making a strong public statement in support of his fight with the General Assembly to restore funding for it. These design plans in a design or similar packet would reasonably be assumed to be readily available, otherwise how would any know what they were fighting for and, more importantly, what VMI was getting and justifying in the budget request?
The "Records showing the proposed floorplan, cost, and related information for the Center for Leadership and Ethics Phase II" should be immediately available given the controversy and that VMI is asking for over $68M to fund it.
Please explain.

As you may be aware, the construction of a building is the culmination of years of coordination and planning that goes into the process. It will take the construction manager at least an hour to cull through those records to determine what records are responsive to your request.
