To Whom It May Concern:

Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

Records identifying the Virginia Military Institute Records retention officer and all approved records retention and disposition schedules (RM-3, etc.) for the 2020 – 2021, 2021 – 2022, 2022 – 2023, 2023 – 2024 and 2024 – 2025 academic years.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

A message was sent to you regarding record request #25-5:

VMI requires all outstanding balances in excess of 30 days be paid, in accordance with Va. Code § 2.2-3704(I.), On Dec. 3, 2024 when responsive records were released, you were also provided an invoice for the actual cost of fulfilling request 24-73 in the amount of $138.66. However, only payment in the amount of $76.30 was received leaving a balance of $62.36. Until this balance is paid, VMI will not begin processing this and future requests.

This FOIA did not provide the information requested. Specifically, I requested: "Records identifying the Virginia Military Institute Records retention officer and all approved records retention and disposition schedules (RM-3, etc.) for the 2020 – 2021, 2021 – 2022, 2022 – 2023, 2023 – 2024 and 2024 – 2025 academic years." While these policies list a "Job Title" for the records manager they do not provide the name of the Records Retention Officer during these periods. Also, this FOIA did not include "all approved records retention and disposition schedules (RM-3, etc.)" or similar documents describing and certifying the documents destroyed. Such required records of documents destroyed shuld be available if VMI properly recorded them. If they do not exist please confirm that VMI did not create or maintain retention and dispositions schedules (or equivolent documents) for the records destroyed during these periods.

Responsive records provided clearly identified the Institute's record retention officer. Additionally, the general order states, "The Virginia Military Institute complies with all requirements for records retention and destruction

as governed by the VPRA. Records retention and disposition schedules for state agencies are created and maintained by the Library of Virginia." Retention schedules are available on the Library of Virginia website.
