To Whom It May Concern:

Pursuant to the Michigan Freedom of Information Act, I hereby request the following records:

1) Municipal data for all challenges made by members of the public to other voters’ registrations from November 3, 2020 to the time that the request is processed. Please make sure that the responsive documents include the name of the person who filed the voter challenge as well as the materials they submitted as part of their challenge claim.

2) Correspondence and details related to the processing and, if applicable, the outcome (approval, rejection, etc.) of the voter challenge claim. This is also for the same time period, or November 3, 2020 to the time that the request is processed.

I would like these records in electronic format, sent via email or other digital method.

If there are any questions about my request, I am happy to hop on the phone (914-817-4482) in addition to corresponding via email.

If you determine that any of the information qualifies for an exemption from disclosure, I ask you to note whether the exemption is discretionary, and if so whether it is necessary in this case to exercise your discretion to withhold the information. In any event, please provide a signed notification citing the legal authorities on which you rely if you determine that any of the information is exempt and will not be disclosed.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hi Lori,

Thanks for this response to my FOIA request! I was wondering if I could get a copy of the documents you reference in your response, as per my original request. For example, it would be great to get copies of the challenges made by Michele Haroon, Mark Vaeth, and the Election Integrity Force, specifically any emails they sent and attached documents or spreadsheets detailing their challenge. Documents detailing your office's response to their challenge -- for example email correspondence or any notices sent to those challenged -- would also be helpful.

Hi Lori,

Thank you so much for collating these records and sharing them. I wanted to confirm one thing: Did Mark Vaeth say anything in his email? I believe I only have a copy of his list of deceased voters, but not the actual email in which he attached this sheet.

Also, is it accurate to assume that the City of Livonia did not respond to any of these challenger emails (I am assuming so, given that they are not included in the attachments you shared), aside from sending out the challenge notices mailed out?

A FOIA request can be made for any agency record. You can also specify the format in which you wish to receive the records (for example, printed or electronic form). The FOIA does not require agencies to create new records or to conduct research, analyze data, or answer questions when responding to requests.
