1) All phone, text or email correspondence between your department and National Basketball Association (NBA) staff referencing Miles Bridges (DOB: 3/21/98) between the following dates:

6/30/22-4/14/2023

3) We're also requesting 911 calls, arrest reports, and investigative records (which can include chronological records of events, property and evidence logs, witness lists, interview notes from officers examining the case, photos and videos included in the case file, search warrant affidavits, case summaries, and charges recommended to the prosecuting agency) referencing Miles Bridges (DOB: 3/21/98) between the following date range:

6/30/22-4/14/2023

5) We're also requesting a FOIA log for related requests referencing Miles Bridges (DOB: 3/21/98) between 6/30/22 and the date this request was received. We want:

1) The log or file number
2) The date the request was received
3) The name of the persons/organization (besides ourselves) making requests related to the above
4) A description of the information sought
5) The date the response was sent
6) The type of response your office sent (granted, denied or partial release)

If you determine that some but not all the information is exempt from disclosure and that you intend to withhold it, I ask that you redact it for the time being and make the rest available on a rolling basis. In any event, please provide a signed notification citing the legal authorities on which you rely if you determine that any information is exempt and will not be disclosed.

The requested documents will be made available to the general public free of charge and processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. Dear Requester:

 

We reviewed your request for various records regarding Miles Bridges.

 

Your request was made under the California Public Records Act (the Act). The Department is cognizant of its responsibilities under the Act. It recognizes the statutory scheme was enacted to maximize citizen access to the workings of government. The Act does not mandate disclosure of all documents within the government’s possession. Rather, by specific exemption and reference to other statutes, the Act recognizes that there are boundaries where the public’s right to access must be balanced against such weighty considerations as the right of privacy, a right of constitutional dimension under California Constitution, Article 1, Section 1. The law also exempts from disclosure records that are privileged or confidential or otherwise exempt under either express provisions of the Act or pursuant to applicable federal or state law, per California Government Code Sections 7927.200; 7927.700; 7923.600-7923.625; 7927.705; and 7922.000.

 

In regard to all phone correspondences and item 5, the Department has conducted a search based on the information provided and no responsive records were located.

 

Specifically, regarding item 5, the Department does not have a record that contains the specific items you are seeking.

 

However, you may search the NextRequest Portal with "Miles Bridges" as the keyword for California Public Records Act requests that may be related to your request.

 

In regard to all emails to and from NBA staff, please be advised that, pursuant to California Government Code Section 7922.535, we have found that “unusual circumstances” exist with respect to the request due to the need to search for, collect, and review the requested records from other Department entities which are separate from the office processing the request. Therefore, we will require the statutory fourteen days extension of time in which to respond. A determination concerning your request will be made as soon as possible.

 

In regard to all text messages and emails to or from Charlotte Hornets staff, please provide Department employee names or serial numbers, email addresses or domains, and keywords so that the Department may conduct a focused search for records responsive to this portion of your request.

 

We ask that you provide a response by December 26, 2024. If we do not receive a response by the date indicated, then we will consider this request closed.

 

In regard to item 3, the Department has conducted a search based on the information provided and no responsive records were located.

 

However, the Department conducted a secondary search and located records from June 27, 2022. In accordance with the California Government Code, Sections 7923.600-7923.625, records of investigations conducted by, or investigatory files compiled by, any local police agency for law enforcement purposes are exempt from disclosure. To the extent that records were located, they are either investigatory records themselves or properly part of an investigative file. Therefore, we are denying your request. Should any records be located, they may be available in response to a subpoena or court order related to pending litigation.
