1) All phone, text or email correspondence between your department and National Basketball Association (NBA) staff referencing Jaxson Hayes (DOB: 5/23/2000) between the following dates:

7/1/2021-7/1/2022
11/1/2024 - the date this request is received

While correspondence between your department and NBA staffers may include conversations with people beyond the following names, I've provided these people to assist with your search:

2) All phone, text, or email correspondence between your department and New Orleans Pelicans staff referencing Jaxson Hayes (DOB: 5/23/2000) between the following dates:

3) All phone, text or email correspondence between your department and Los Angeles Lakers staff referencing Jaxson Hayes (DOB: 5/23/2000) between the following dates:

7/1/2023-8/1/2023
11/1/2024-the date this request is received

4) We're also requesting 911 calls, arrest reports, and investigative records (which can include chronological records of events, property and evidence logs, witness lists, interview notes from officers examining the case, photos and videos included in the case file, search warrant affidavits, case summaries, and charges recommended to the prosecuting agency) referencing Jaxson Hayes' (DOB: 5/23/2000) between the following date range:
7/1/2021-7/1/2022

5) We're also requesting a FOIA log for related requests referencing Jaxson Hayes (DOB: 5/23/2000) between 7/1/2021 and the date this request was received. We want:

1) The log or file number
2) The date the request was received
3) The name of the persons/organization (besides ourselves) making requests related to the above
4) A description of the information sought
5) The date the response was sent
6) The type of response your office sent (granted, denied or partial release)

If you determine that some but not all the information is exempt from disclosure and that you intend to withhold it, I ask that you redact it for the time being and make the rest available on a rolling basis. In any event, please provide a signed notification citing the legal authorities on which you rely if you determine that any information is exempt and will not be disclosed.

The requested documents will be made available to the general public free of charge and processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. We reviewed your request for various records regarding Jaxson Hayes,

 

Your request was made under the California Public Records Act (the Act). The Department is cognizant of its responsibilities under the Act. It recognizes the statutory scheme was enacted to maximize citizen access to the workings of government. The Act does not mandate disclosure of all documents within the government’s possession. Rather, by specific exemption and reference to other statutes, the Act recognizes that there are boundaries where the public’s right to access must be balanced against such weighty considerations as the right of privacy, a right of constitutional dimension under California Constitution, Article 1, Section 1. The law also exempts from disclosure records that are privileged or confidential or otherwise exempt under either express provisions of the Act or pursuant to applicable federal or state law, per California Government Code Sections 7927.200; 7927.700; 7923.600-7923.625; 7927.705; and 7922.000.

 

In regard to all phone correspondences and item 5, the Department has conducted a search based on the information provided and no responsive records were located.

 

In regard to all text messages and emails, please provide Department employee names or serial numbers, other email addresses or domains, and keywords so that the Department may conduct a focused search for records responsive to these portions of your request.

 

In regard to item 4, in accordance with the California Government Code, Sections 7923.600-7923.625, records of investigations conducted by, or investigatory files compiled by, any local police agency for law enforcement purposes are exempt from disclosure. To the extent that records were located, they are either investigatory records themselves or properly part of an investigative file. Therefore, we are denying your request. Should any records be located, they may be available in response to a subpoena or court order related to pending litigation.

 

We have extended this request for the statutory fourteen days to provide you with the opportunity to respond. Please respond by no later than December 5, 2024, if you wish to proceed. If we do not receive a response by the date indicated, we will consider this request closed.
