Pursuant to the California Public Records Act, I hereby request the following records:

I am writing to formally request records related to a Los Angeles Police Department raid that took place in October 2023 at the NoHo Diagnostic Center, located in the Van Nuys neighborhood of Los Angeles. Specifically, I am requesting the following records:

1. Body camera footage: Any and all body-worn camera footage recorded by LAPD officers during the raid on the NoHo Diagnostic Center, including any video prior to, during, and after the incident where an officer’s rifle was attracted to an MRI machine.

2. Incident Reports: Any official incident or field reports prepared by LAPD officers regarding the raid at the NoHo Diagnostic Center, including any documentation of the circumstances surrounding the raid, property damage, and the involvement of LAPD officers.

3. Communications: Any and all communications (emails, text messages, memos, etc.) between LAPD officers, supervisors, and/or other relevant officials regarding the planning, execution, or aftermath of the raid on the NoHo Diagnostic Center. This includes any communications referencing cannabis cultivation, energy usage monitoring, and the distinct odor cited in the lawsuit.

4. Internal Investigation Records: Any records related to internal reviews or investigations conducted by the LAPD into the actions taken by officers during this raid, including the incident involving the MRI machine and any other property damage claims.

5. Photographs: Any photographs taken by LAPD officers or forensic units at the scene of the NoHo Diagnostic Center during or following the raid.

If any portion of these records is exempt from disclosure, I request that you release any segregable, non-exempt portions of the records. Please do not withhold the entire set of records if certain parts are subject to exemption, in accordance with public records laws.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

We have received your request for various records related to the incident that occurred in October 2023 at the North Hollywood Diagnostic Center.

 

Your request was made under the California Public Records Act (the Act). The Department is cognizant of its responsibilities under the Act. It recognizes the statutory scheme was enacted to maximize citizen access to the workings of government. The Act does not mandate disclosure of all documents within the government’s possession. Rather, by specific exemption and reference to other statutes, the Act recognizes that there are boundaries where the public’s right to access must be balanced against such weighty considerations as the right of privacy, a right of constitutional dimension under California Constitution, Article 1, Section 1. The law also exempts from disclosure records that are privileged or confidential or otherwise exempt under either express provisions of the Act or pursuant to applicable federal or state law, per California Government Code Sections 7927.200; 7927.700; 7923.600-7923.625; 7927.705; and 7922.000.

Regarding requested item No. 1,2,4, and 5, in accordance with Sections 7923.600-7923.625 of the California Government Code, records of investigations conducted by, or investigatory files compiled by, any local police agency for law enforcement purposes, are exempt from disclosure. To the extent that records were located, they are either investigatory records themselves or properly part of an investigative file. Therefore, we are denying your request. The records may be provided pursuant to a subpoena or court order related to pending litigation.

For Requested item No.3:

Regarding text messages, please also note that currently the Department has over 11,600 employees, thus we are unable to conduct a search for text messages based on the information provided. If you wish to proceed with this item, please provide additional information (name, serial numbers, date range etc.), to assist with the search. Please respond by no later than October 28, 2024. If we do not receive a response by the date indicated, we will consider this item closed.

Regarding email communications, please note that our office—the LAPD Public Records and Subpoena Response Section, CPRA Unit—does not house the records you are seeking. The Department is in the process of searching for the requested records. Please note that some of the records to be provided may be redacted pursuant to California Government Code Sections 7927.200; 7927.700; 7923.600-7923.625; 7927.705; and 7922.000. We will make every effort to produce the requested records by November 18, 2024 and will notify you should anything change.
