Pursuant to the California Public Records Act, I hereby request the following records:

The company Surfline has been advertising persistent monitoring of California beaches: www.surfzone.ai. Therefore, I request the following:

1) All instructional materials, presentations and presentation materials (including recorded video and audio, PowerPoint files, prepared remarks, and slides formats), and other guidance on the use of Surfline or Surfzone.ai. This includes A) any notes taken during meetings that discussed the use of Surfline, B) any explanations (whether internally or externally generated) of how Surfline works, and C) any other document that has been used to help explain the use of Surfline, including internal documentation, public relations materials, and executive summaries.

2) A copy of any privacy impact assessments, use policies, standard operating procedures, data retention policies, legal opinions, warranties, non-disclosure agreements, contracts, liability waivers, insurance agreements, Requests for Proposals, Responses to Requests for Proposal, Memorandums of Understanding, Letters of Interest, usage policies, or informal agreements between the department and Surfline, Surfzone.ai, or Wavetrak.

3) A copy of any funding opportunity announcements, grant applications and grantor status/progress reports, reports to legislative bodies, annual reports that mention Surfline, Surfzone.ai, or Wavetrak, as well as audit records, including but not limited to security audits of the software, misuse reports, and reports to oversight bodies.

4) Any digital communications including but not limited to emails and text messages) as well as documents, (including but not limited to PDF, word processing, excel, and slide documents) that mention Surfline, Surfzone.ai, or Wavetrak.

5) Any case reports in which Surfline was used.

6) Any digital communications (including but not limited to emails and text messages) with Surfline, Surfzone.ai, or Wavetrak representatives.

The documents will be used in the course of reporting for 404 Media, an independent tech journalism website (www.404media.co)

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We have reviewed your California Public Records Act request. 

 

Please be advised that, pursuant to California Government Code Section 7922.535, we have found that “unusual circumstances” exist with respect to the request due to the need to search for, collect, and review the requested records from other Department entities which are separate from the office processing the request. Therefore, we will require the statutory fourteen days extension of time in which to respond. A determination concerning your request will be made as soon as possible.

 

In regard to, "Any digital communications (including but not limited to emails and text messages) with Surfline, Surfzone.ai, or Wavetrak representatives", please note that currently the Department has over 11,600 employees, thus we are unable to conduct a search based on the information provided. We ask that you provide additional information (names, email domains, date range, serial numbers, etc.), to assist with the search. Please respond by no later than June 27, 2024, if you wish to proceed. If we do not receive a response by the date indicated, we will consider this portion of the request closed.

Your request was made under the California Public Records Act (the Act). The Department is cognizant of its responsibilities under the Act. It recognizes the statutory scheme was enacted to maximize citizen access to the workings of government. The Act does not mandate disclosure of all documents within the government’s possession. Rather, by specific exemption and reference to other statutes, the Act recognizes that there are boundaries where the public’s right to access must be balanced against such weighty considerations as the right of privacy, a right of constitutional dimension under California Constitution, Article 1, Section 1. The law also exempts from disclosure records that are privileged or confidential or otherwise exempt under either express provisions of the Act or pursuant to applicable federal or state law, per California Government Code Sections 7927.200; 7927.700; 7923.600-7923.625; 7927.705; and 7922.000.

In regard to items 1-3 and 5, the Department has conducted a search and no responsive records were located.

In regard to item 4, the Department has determined that additional information is need to search for records such as dates, email addresses and names/serial numbers. Please provide a response by July 19, 2024 or we will consider this portion of the request closed.
