To Whom It May Concern:

Pursuant to the Maine Freedom of Access Act ("FOAA"), I hereby request the following records:

Listings of those persons who are issued a concealed handgun permit for the past five years. If possible, please send listings segregated by year of permit application/issuance.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by 1 M.R.S.A. § 408(6). The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

To the extent our agency has records responsive to your request, such records are confidential pursuant to recently enacted and signed Public Law 2013, Chapter 54, An Act To Ensure the Confidentiality of Concealed Handgun Permit Holder Personal Information. Accordingly, as a matter of law, our agency must deny your request.

Hello,

Thank you for your quick response. In light of the enactment of Public Law 54, I request instead the following:

The "suitable book or file" of permanent records of concealed carry permits.

Public Law 54, Section 2006(2) reads:

2. Permanent record of permit. The issuing authority shall make a permanent record of each permit to carry concealed handguns in a suitable book or file kept for that purpose. The record must include the information contained in the permit itself. The record is confidential except that the following information about each permit holder is not confidential and is a public record:
A. The municipality of residence;
B. The date the permit was issued; and
C. The date the permit expires.

So, to be clear: With respect to concealed handgun permits issued by the Maine State Police, you want access to a record that contains (1) the name of the municipality of residence of each permit holder, (2) the date each given issued permit was issued, and (3) the date each given issued permit, expires?
