Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

- Number of individuals who are not employed by the BRIC or a contractor who are authorized by the PM-ISE to access the Commonwealth Fusion Center's (CFC) Criminal Intelligence system and all other intelligence systems, such as those that house information not based on "reasonable suspicion".

- Number and list of non-fusion center agencies authorized to access the CFC's intelligence systems, such as the Criminal Intelligence system and all other intelligence systems, including those that house information not based on "reasonable suspicion".

- Number and list of source agencies who have submitted information to the CFC's Criminal Intelligence system and all other intelligence systems.

- Number of times information posted to the CFC's intelligence systems had to be corrected or removed because it was erroneous or deficient, or because the source agency did not have authority to gather or share the information.

- Any documents relating to any instances where source agencies were determined to have used prohibited means to acquire information, or to have lacked the authority to acquire the original information or submit it to the CFC's intelligence systems.

- Number of times CFC personnel, a participating agency, or an authorized user have been found to be in noncompliance with the CFC privacy policy in regards to the gathering, collection, use, retention, destruction, sharing, classification, or disclosure of information.

- Records of all complaints received by the CFC and requests for corrections and the resulting action, if any.

- Breakdown of number of suspicious incident reports, suspicious activity reports, and field interview reports in the CFC's intelligence systems.

- Number and list of all public agencies and private contractors providing SAR and ISE-SAR information technology or related services to the CFC.

- Breakdown of the number of tips and leads in the CFC's intelligence systems acquired via intelligence information or email, phone, internet or incident report submission.

- Number of tips and leads in the CFC's intelligence systems acquired from cellphone tower dumps, cell site simulators (commonly known as "Stringrays"), and surveillance cameras.

- List of external agencies that access the CFC's intelligence systems or share information with the CFC.

- Number of persons within the CFC or in other governmental agencies who are authorized to have access to the CFC's intelligence systems.

- Number of complaints made to the Privacy Officer of the CFC.

- Number of times the CFC has notified individuals that their personal information was or is reasonably believed to have been breached or obtained by an unauthorized person.

- Number of times CFC personnel, a contractor, a participating agency, or an authorized user have been suspended, sanctioned, or otherwise disciplined.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello,

I realize that I have made a typo in my request. The first part of the request reads:

"Number of individuals who are not employed by the BRIC or a contractor who are authorized by the PM-ISE to access the Commonwealth Fusion Center's (CFC) Criminal Intelligence system and all other intelligence systems, such as those that house information not based on "reasonable suspicion"."

The word 'BRIC' should say 'CFC' as in Commonwealth Fusion Center. I hope this is an easy fix and doesn't lead to any more confusion.

Thank you for your response to my public records request. I would like to modify my request to include the following:

In addition, I would like to request access to any data mentioning the names "Evan Anderson" or "Alex Marthews." According to the CFC privacy policy, "[u]pon satisfactory verification of identity, any individual ("data subject") may access and review any personal data . . . relating to the data subject and which personal information is within the possession of the CFC." We would appreciate it if you could inform us on how to provide a satisfactory verification of identity in order to complete this portion of the request.

Good Morning Mr. Anderson,

This email is in response to your public records request regarding the Fusion Center’s Intelligence database. Although your initial request encompassed many items, the $150.00 estimate was in response to providing you information for items #3 and #13 of your request. Accordingly, upon receipt of the $150.00 estimate payment, the Department did, in fact, perform the large data transfer from the intelligence system in order ascertain the responsive information to those items. Please see below for the responsive information.

In response to Item 3 of your request seeking the “number and list of sources who have submitted information to the CFC’s Criminal Intelligence system”: there have been 52 sources. Please see the attached list of sources.

In response to Item 13 of your request seeking the “number of persons within the CFC or in other governmental agencies who are authorized to have access to the CFC’s intelligence systems”: there are 1,177 current and active authorized users.

Lastly, in response to Item 2 of your request seeking the “number and list of non-fusion center agencies authorized to access the CFC’s intelligence systems, such as the Criminal Intelligence system and all other intelligence systems, including those that house information not based on reasonable suspicion,” the Department informed you that there are no outside agencies who can access both the Criminal Intelligence system and our other database of information. There are, however, 194 agencies authorized to access the CFC’s intelligence system.

If you object to the Department’s response to your request or any portion of the same, you may appeal the Department’s response in accordance with Massachusetts General Laws, Chapter 66, §10(b) and 950 CMR 32.00.
