Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, §10, I hereby request the following records:

All email communications between Commonwealth Fusion Center employees and all private security firms (including G4S, Harris Corporation, etc).

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

To Whom It May Concern:

Consider this an appeal to the completion of my public records request.

On June 26, 2014, I filed a request for:

“All emails between Fusion Center and Security vendors, including emails concerning business relationships as well as those concerning the exchange of intelligence information.”

I filed this request with the Commonwealth Fusion Center, which is operated by the Massachusetts State Police.

The documents pursuant to my request pertain only to business relationships between the Commonwealth Fusion Center and firms that provide security equipment and/or services in the sense that they provide security for the premises of the Fusion Center (i.e., alarm systems to detect intruders). The word “security” in my original request is meant to include “information security” (i.e., agencies providing information technology services for the Fusion Center) and not merely “physical” security, as it appears to have been interpreted. In addition, I was led to believe (through my correspondence with David Procopio) that some of the emails would concern the exchange of intelligence information, however none of the emails provided to me appear to be related to the exchange of intelligence information at all.

Attached is my original request, my correspondence with David Procopio, and the responsive documents referred to in this appeal.
