Pursuant to the state Freedom of Information Act, G.L.M. c.66, §10, I hereby request the following records:
A copy of complaints submitted to the Division of Banks Consumer Assistance Unit concerning ATMs. If an index, database, or other summary of these complaints is compiled, please provide this index, database or summary instead.
I also request any index, database, or other summary that records investigations into ATMs. If no indexes, databases or summaries of these investigations are compiled, please provide the case files for the documents.
I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Dear Mr. Morisy:
This letter is in response to your public records request pursuant to Massachusetts General Laws (M.G.L.) c. 66, § 10 in which you requested copies of certain records held by the Division of Banks, specifically:
* A copy of complaints submitted to the Division of Banks Consumer Assistance Unit concerning ATMs. If an index, database, or other summary of these complaints is compiled, please provide this index, database or summary instead.
* Any index, database, or other summary that records investigations into ATMs. If no indexes, databases or summaries of these investigations are compiled, please provide the case files for the documents.
The Division has reviewed and collected records responsive to your request to the extent that such Division records are not exempt from disclosure pursuant to M.G.L. c. 4, § 7, cl. 26 and M.G.L. c. 66A, § 1. Attached please find information responsive to your requests.
In response to the second portion of your request, attached is a copy of an agency directive, issued in January 2013, relating to a reported occurrence of the operation of an unapproved ATM in the Commonwealth. Also, two consent orders entered by the Division as a result of ATM investigations are available on the Division's website at:
Please be advised that the consumer complaint records provided with this response contain data relating to specifically named individuals, the disclosure of which may constitute an unwarranted invasion of personal privacy in accordance with the provisions of M.G.L. c. 4, § 7, cl. 26(c), so this data has been redacted.
