Pursuant to the state Freedom of Information Act, G.L.M. c.66, §10, I hereby request the following records:

Any and all mug shots taken of Francis P. Salemme [Salemone] taken between the days of April 10, 1955 and April 10, 1995.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is in response to the May 3, 2012 rejection of nine public records requests between April 11 and April 26, in which I requested booking photos for Larry Baione, Dennis Chandler, Arnold Campbell, Alvin Campbell, Vincent DeScisio, Joseph R. Russo, Francis Salemme, Guido St. Laurent and George McLaughlin.
With the exception of Arnold Campbell, Vincent DeScisio and Guido St. Laurent, booking photos for each of these individuals appears in the book Boston Organized Crime by Emily Sweeney published in 2012. Each of the photos – excepting Arnold Campbell, DeScisio and St. Laurent – is attributed, Courtesy of Massachusetts State Police. The Massachusetts State Police and a staff member are thanked in the acknowledgements of the book.
Deputy Chief Legal Counsel Catherine Bailey of the Massachusetts State Police denied the initial request, citing Supervisor Cote’s April 22, 2011 correspondence to Andy Metzger, Somerville Journal. However, in recognition that the Massachusetts State Police has previously released the photos of Baione, Chandler, Alvin Campbell, Russo, Salemme and McLaughlin to journalist Sweeney and they were published by Images of America in Boston Organized Crime, I am seeking an appeal to the May 3, 2012 correspondence. I am amending my request to include only the mugshots previously released by Massachusetts State Police - Larry Baione, Dennis Chandler, Joseph R. Russo, Francis Salemme, and George McLaughlin.
