Pursuant to the Tennessee Public Records Act, I hereby request the following records:

Any agreements related to beverage pouring, distribution or selling rights on campus and/or athletic facilities and venues.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

Hello,

To follow up I see that you've indicated that our request was not detailed enough and you don't retain the records? To give the request more detail I am inquiring about any agreements with beverage providers, such as Coca Cola or PepsiCo, that the university has for primary beverage selling or pouring rights on campus. Or should I assume the if the office doesn't retain this record that the University does not have a partnership agreement with a beverage provider?

Ms. North:

The University is not obligated to provide responses to questions, however, as a courtesy and to clarify, the previously provided records response included 36 pages of responsive records, namely the University’s agreement with PepsiCo. Your request was overly broad and vague and would seem to indicate that you believe the University controls the beverage operations at other facilities we may use. The University is not obligated to obtain records from other entities to satisfy your request, nor are we required to sort through and compile records. Your request must be specific enough for me to identify the specific record being requested.

Additionally, you are not the original requestor and I have doubt that he made the original request. This will be our final response on the matter.
