Pursuant to the Tennessee Public Records Act, I hereby request the following records:
1. Any guidance, policies, or training concerning or mentioning enforcement of speeding, the hands-free law (including references to "distracted driving", "hands-free", or "hands free"), or Tenn. Code §§ 55-8-152 (speeding), 55-8-153 (speeding), 55-8-199 (hands-free law), 55-10-207 (citation in lieu of arrest), or 40-6-215 (arrest warrants). This request is limited to currently-applicable guidance, policies, or training.
2. Any statistics maintained by your agency which concern the rate of stops, citations, or arrests for moving violations, speeding (including Tenn. Code §§ 55-8-152, 55-8-153), or distracted driving (including Tenn. Code §§ 55-8-199). This request is limited to statistics generated on or after January 1, 2018.
3. A copy of any (a) incident report, (b) warrant application, (c) warrant affidavit, or (d) warrant where the report, application, affidavit, or warrant involves or seeks an arrest (not citation) for speeding or the hands-free law, including any violation of Tenn. Code §§ 55-8-152, 55-8-153, or 55-8-199. This request is limited to reports, applications, affidavits, or warrants generated on or after January 1, 2018.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This request far exceeds your maximum limit of $25.00. The lowest rate of pay is $19.37 and this request will involve various positions and rates of pay. Currently it has taken 3 hours of research just to provide an estimate and your total is $38.74, the first hour was free. To complete the request it would take approximately 25 weeks at the very minimum of $19.37 per hour. Please advise how you wish to proceed.
Item #1 – 37.25 hours (Skilled Clerk) – Approximately 2 weeks to produce the requested items.
· It would take approximately 1 hour to locate and provide a copy of any policies related to the items being requested.
· It would take approximately 15 minutes per police officer to research their training files in order to identify if any individual training exists related to this request. There are currently 145 Police Officers. (145 x .25 hours = 36.25 hours).
Item #2 – 2+ hours (Crime Analyst) – Approximately 1 week to produce the requested items.
· We can provide statistical data as it relates to the number of Citations & Arrests for Speeding & Distracted Driving, but we cannot provide the number of Traffic Stops related to this category. We only collect this specific data if a citation or arrest is generated. It would take approximately 2 hours to locate and provide a copy of any statistics related to the items being requested. If we need to include other moving violations besides Speeding & Distracted Driving, the time to perform this additional search is unknown as additional coding would be required to conduct such a query, if possible.
Item #3 – 867.68 Hours (Skilled Clerk) + 3 Hours (Crime Analyst) – Approximately 25 weeks to produce the requested items.
· (A) It appears there are 1,496 reports which meet the criteria being requested. It is estimated that it would take approximately 15 minutes per report to redact and produce such documents (1,496 x .25 hours = 374 hours).
· (B) (C) (D) It appears there are 1,496 reports which meet the criteria being requested. It is estimated that it would take approximately 20 minutes per incident to locate, redact, and produce such documents (1,496 x .33 hours = 493.68 hours)
· Our Crime Analyst has already spent 3 Hours in order to identify the 1,496 reports for this category.
· Assuming the PD Records Division and Court Clerk Records Division worked concurrently at 20 hours each per week, it would take approximately 25 weeks to complete this request.
