Pursuant to the Michigan Freedom of Information Act, I hereby request the following records:

The law states that "The MIDC shall ensure proper financial protocols in administering and overseeing funds utilized by indigent criminal defense systems, including, but not limited to, all of the following: (a) Requiring documentation of expenditures. (b) Requiring each indigent criminal defense system to hold all grant funds in a fund that is separate from other funds held by the indigent criminal defense system. (c) Requiring each indigent criminal defense system to comply with the standards promulgated by the governmental accounting standards board." MCL 780.993(14).

Please provide documentation of expenditures that has been submitted by Wayne County to the MIDC, in addition to the corresponding years' approved disbursement documentation for fiscal years 2019-2020, 2020-2021, and 2021-2022. Please ensure this information includes documentation of any unspent funds, and if those funds were itemized for any particular program or organization.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

As to the partial grant, the records are available in the .  Please note, however, that the MIDC is still reviewing some of the documents submitted by Wayne County.  Therefore, final figures may not be accurate. FOIA Center
As to the partial denial, the records/information you requested have been redacted because they contain information of a personal nature [account and employee-identification numbers] that, if disclosed, would constitute a clearly unwarranted invasion of an individual’s privacy.  MCL 15.243(1)(a).
Also, some of the records/information you requested are specifically described as exempt from disclosure by a statute outside of the FOIA.  MCL 15.243(1)(d).  Specifically, MCL 780.987(10) provides that "[c]onfidential case information, including, but not limited to, client information and attorney work product, is exempt from disclosure under the" FOIA.  Therefore, case-specific information on certain expenditures was redacted consistent with this provision. Under section 10 of the FOIA, MCL 15.240, the Department is obligated to inform you that you may do the following: 1)  Appeal this decision in writing to Appeals Officer Adam Sandoval, Department of Licensing and Regulatory Affairs, P.O. Box 30004, Lansing, MI 48909.  The writing must specifically state the word “appeal” and must identify the reason or reasons you believe the partial denial should be reversed.  The head of the Department or her designee must respond to your appeal within 10 business days of its receipt.  Under unusual circumstances, the time for response to your appeal may be extended by 10 business days. 2)  Commence an action in the Court of Claims within 180 days after the date of the final determination to deny the request.  If you prevail in such an action, the court is to award reasonable attorney fees, costs, and disbursements, and possible damages.
Please note: These records will be available in the FOIA Center for 365 calendar days; and will then be destroyed as required by the Department’s records and retention schedule.
