From: Emma North-Best

To Whom It May Concern:

Pursuant to the The Missouri Sunshine Law, I hereby request the following records:

A copy of (U//FOUO) IIB - Criminal Hackers Target US Law Enforcement Data, created on or about June 26, 2020, as well as bulletins and alerts generated, sent or received mentioning or describing "BlueLeaks" (sometimes spelled "Blue Leaks"), "Distributed Denial of Secrets" or "DDoSecrets". You may limit this request to records created between June 18, 2020 and the date of the processing of this request.

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Emma Best

Your public record request has been submitted to the Missouri State Highway Patrol's Custodian of Records for processing.  In compliance with Chapter 610 of the Missouri Revised Statutes, this message serves as the department’s initial response within three business days. Public access and/or copies of the records you requested are not immediately available. The explanation of the cause for delay is that additional time is needed to research, and/or duplicate any records that are responsive to your request and are open pursuant to Chapter 610 of the Missouri Revised Statutes. Furthermore, in the event any information in the records is exempt from disclosure, additional time will be required to redact the information exempt from disclosure prior to providing public access and/or copies. For these reasons, the department anticipates a further response will be provided to you within approximately twenty to thirty business days. You will also be notified if there are any fees associated with producing such reports.
Please do not call to check the status of your request until 30 business days after your request was submitted.  If you wish to withdraw your request or need further clarification regarding your request, please call 573-526-6146 or 573-526-6167.
You can monitor the progress of your request at the link below and you will receive an email when your request has been completed. Again, thank you for using the MO State Highway Patrol Public Records Center.
Sincerely,
Capt. Paul Kennedy

Dear Ms. Best:

The two attachments are printouts of e-mails forwarded to my office you sent to our 24/7 Missouri Information Analysis Center email address inquiring of two requests P019328 and P019401 sent to my office in August of 2020. These appeared to be duplicates to request P019027 sent 7/22/2020. A response was sent to request P019328 advising this was being withdrawn on 8/11/2020 and to refer to the original request P019027. On 9/24/2020 an email clarification was sent to you responsive to the original request P019027 addressing the time that would be involved and the amount of emails so far recovered. No response was received and after 30 days the request was considered closed on 10/24/2020 an email communication was sent advising of this.

Upon further review of your three different request we have noted where you narrowed the scope of the period requested from 21 months to two months in request P019401. If you would like this request to be re-opened you may notify us to do so and I will assign it back to an analyst. The email address this request is connected to is requests@muckrock.com<mailto:requests@muckrock.com>. Should you be utilizing a new email address you would like the request directed to you will have to create a new profile and submit a new request through our on-line request portal at the link below:
