Pursuant to the The Missouri Sunshine Law, I hereby request the following records:

Copies of all consumer complaints regarding dental, group, individual, and Medicare supplement health insurance plans sent to the Division of Consumer Affairs within the Missouri Department of Commerce & Insurance between Jan. 1, 2023 and Dec. 31, 2023.
I’m requesting expedited processing due to a “compelling need” for the public to know about health insurance issues in Missouri.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Hello,

The law cited to deny my request does in fact allow for the release of such records. Under section 374.071, RSMo, the state "may release an incident report record consisting of the date and immediate facts and circumstances surrounding the initial consumer report or complaint."

I am not seeking the personal information of Missourians but rather the substance of their complaints. I am requesting that the department make the necessary redactions and provide me with these records. These documents are crucial for understanding the insurance challenges Missourians encounter and how these issues impact their access to health care services.

Hi, Amy,

Thanks for the guidance. Is it possible to narrow this request to one insurer and by the type of plan and the month filed?

If so, I'd like to request copies of all incident report records consisting of the date and immediate facts and circumstances surrounding the initial consumer report or complaint for Anthem's self-funded/ERISA plans regarding incidents filed with the department between Jan. 1, 2023 and Jan. 31, 2023.
