Pursuant to the The Missouri Sunshine Law, I hereby request the following records:
1) A copy of the database used by the Department of Revenue and other administering agencies to track the “amount of tax credits authorized, issued, and redeemed,” pursuant to MRS Section 135.825.1.
The following statutes should also be taken into consideration:
MRS 135.630.2(9): Which explicitly, and redundantly permits “The disclosure to the public of any information, or facts shown thereby regarding the claiming of a state tax credit by a member of the Missouri general assembly or any statewide elected public official.”
MRS 135.805.14: “Notwithstanding provisions of law to the contrary, every agency of this state charged with administering a tax credit program authorized under the laws of this state shall make available for public inspection the name of each tax credit recipient and the amount of tax credits issued to each such recipient.”
MRS 135.805.15: “The department of economic development shall make all information provided under the provisions of this section available for public inspection on the department's website and the Missouri accountability portal.”
Please note that the database I am requesting is not the one found at: https://mapyourtaxes.mo.gov/MAP/TaxCredits. I'm seeking the DoR's database that includes transferees, recipients, and the price paid for the tax credit. I understand some of the data fields in the database I am requesting may be exempt from disclosure (such as addresses, SSNs, etc.). I acknowledge that those fields should be redacted or removed from the copy of the database you provide me, but it does not preclude the release of the other fields in the database.
I ask that all fees be waived for this request as I am a journalist (examples of my work can be found at toddfeathers.com).
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.
