This is a request for records under the Missouri Sunshine Law, Chapter 610, Revised Statutes of Missouri.
Copies of all electronic or paper reports in the course of the investigation into the fight between Crossroads Correctional Center inmate Paul Ferguson (MoDOC number: 18782) and his cellmate on August 17, 2018. The fight resulted in Ferguson's death.
I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as provided under Missouri Law. The requested documents will be made available to the general public free of charge as part of the public information service processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
I expect the request to be filled in an electronic format preferably a .pdf file attached to a responsive email. In the alternative physical documents would also be acceptable. In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.
If portions of the requested records are closed, please segregate the closed portions and provide me with the rest of the records. If any of the records are closed, please cite the law and provide a general description of the reason for not disclosing the records.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Dear Ms. McClain:
State law (section 217.075.1(1) prohibits the Department from releasing "any information, report, record or other document pertaining to an offender's personal medical history." Releasing information in violation of this law is class A misdemeanor. See 217.075.8. The law provides no exception if the offender is deceased.
For this reason, we are unable to provide records responsive to your request.
For information regarding a criminal investigation associated with an offender's death, please contact the local prosecuting attorney's office.
