Pursuant to the Alabama Public Records, I hereby request the following records:

1) All reports regarding Work Opportunity Tax Credits certified in 2019 and 2020 provided to the US Department of Labor, including forms 9058.
2) Any database maintained by your department tracking Work Opportunity Tax Credit certifications, preferably in .csv or .xlsx format.

My goal is to ascertain which businesses and industries are applying for and/or receiving Work Opportunity Tax Credits, for which categories of employees and which occupations. If a conversation could help narrow or expedite the completion of this request, I am available at 802 233 4992 and emily_corwin@harvard.edu.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hi Joseph,

Thanks so much for your speedy reply. I’d like to appeal this denial on the following basis:

Neither of my requests are for “work records,” nor are they relevant to the Unemployment Compensation chapter cited.

In request #1 I am seeking the quarterly reports which your department is required to send to the US DOL regarding AL WOTC certifications. These quarterly reports do not include any identifying information of employers OR employees. Here is a<https://www.dol.gov/sites/dolgov/files/ETA/wotc/pdfs/ETA%20Form%209058.pdf> copy of the blank form.

In request #2 I am seeking the database your department uses to create these reports. Presumably the database is organized by tax credit certification. If sharing the entirety of the database (and redacting any confidential information) is burdensome, I would accept a report containing the following information for 2018 through present:

Business name | WOTC Target Group | Wage / wage category | Occupation / Occupation category

If the database is organized in some other fashion, I would also accept a report with a list of businesses and the counts for each category required in the Form 9058, above.

If you maintain that the records responsive to this request qualify as “work records” under Title 25 Chapter 4, please specify which records you are referring to and how they qualify.

I am working on your request. The records that we can release have been prepared, and you will be contacted soon about the cost associated with retrieving these records. Once those costs are paid, the records will be forwarded to you.

We are not able to publish or open to public inspection in any manner records which reveal an employers’ or employing units’ identity. We are, however, able to produce the ETA Form 9058 that you referenced in your original request.

If you have further questions, please direct them to me. Mr. Ammons is no longer with the agency.
