The request for records responsive to requests 1-3 is
granted. The documents are enclosed.
The request for records responsive to requests 4 - 12 is
denied. Your request is denied for the following reasons, as
permitted by Section 708 of the Right-to-Know Law:
* It is well-established that an agency (as defined in the RTKL)
cannot provide a record that is not in its possession. See
Sanders v. Penn. Bd. of Probation and Parole, No. AP 2009-0069,
*2 (Pa. Off. Open Rec. Mar. 13, 2009) (citing 65 P.S. § 67.305).
Similarly, an agency cannot provide a record that does not
exist. See Hayes v. Penna. Dept. of Corr., No. AP 2013-0946 (Pa.
Off. Open Rec. Jun. 18, 2013). The College does not possess any
records responsive to these requests, nor do such records exist.
Accordingly, these requests are denied.
The request for records of related to requests 13 and 14 is
denied. Your request is denied for the following reasons, as
permitted by Section 708 of the Right-to-Know Law:
* The RTKL requires that requests for records sufficiently and
specifically identify the records sought. RTKL §703. To that
end, the courts have established a three-part test to determine
if the request meets that specificity requirement. See
Pa. Dep’t of Education v. Pittsburgh Post-Gazette, 119 A.3d 1121,
1124 (Pa. Cmwlth. Ct. 2015). The request must identify (1) the
subject matter (2) the scope, either by recipient or by type; and
(3) the timeframe for which records are sought. Id. at
1124-1125. Moreover, as an aspect of the above specificity test
“[t]he subject matter of the request must identify the
‘transaction or activity’ of the agency for which the record is
sought. Pa. Dep’t of Educ., 119 A.3d at 1125.
* With that in mind, your generic request for “communications” is
too broad and encompasses too many different types of records.
See, e.g., Francis Catania v. Chester Upland School District, OOR
No. AP 2020-0538. These generic requests for
“correspondence” is therefore denied. These requests also do not
sufficiently specify the records you are seeking which is
required pursuant to RTKL §703.
Because your request has been denied in part, you are advised of
your right to appeal this decision to the Office of Open Records
(OOR). Any such appeal must be in writing and submitted to the
OOR within fifteen (15) business days of the date of this letter.
It also must include the legal basis for your belief that you
were improperly denied records and address each basis for denial
proffered by the College. The OOR’s address is: Commonwealth
Keystone Building, 400 North Street, 4th Floor, Harrisburg, PA
17120-0225.
Please be advised that this correspondence will serve to close
this record with our office as permitted by law.
