Pursuant to the Government Records Access and Management Act, I hereby request the following records:

1. the total number of use of force incidents from 2017-2022, separated by year. Please include as part of this a breakdown of how many use of force incidents in 2022 were related to law enforcement operations and how many were related to correctional/custodial operations.

2. the total number of use of force incidents, separated by year and type of force, from 2017-2022 (for example, information that specifies the number of taser incidents in 2022, baton incidents in 2022, etc.)
3. the total number of civilian complaints against law enforcement that were reported and the total number sustained from 2017-2022, separated by year.


4. the total number of civilian complaints alleging law enforcement use of excessive force that were reported and the total number sustained from 2017-2022, separated by year.

5. the total number of civilian complaints alleging biased policing or racial profiling that were reported and the total number sustained from 2017-2022, separated by year.


6. the total number of civilian complaints alleging criminal conduct that were reported and the total number sustained from 2017-2022, separated by year.

7. the total number of officer-involved shootings from 2017-2022, both fatal and non-fatal, separated by year.
8. the total number of people who the sheriff’s department used force against, broken down by race/ethnicity, in 2022.

When available, I would appreciate being sent individualized data for each item in this request in spreadsheet format. If individualized data are unavailable, please send information that includes aggregate statistics for the item instead.



Note that my requests for civilian complaints are specifically for civilian complaints alleging police misconduct, please do not include complaints filed by one officer/the department against another officer.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello,

Please see the attached GRAMA form. We would ask that you would authorize up to $100.00 for the research involved in this request. You do not have to send any payment at this time I just need an authorization that you would be willing to pay those fees. The cost may be less than that, and I will figure that after the request has been done.

Also we did not start tracking our use of force incidences until 2020. I can provide the numbers since then and I can also include 2023 if you wish.

Hello,

Here is your response for this request:

Regarding the attached file, our use of force incidents are filed by each deputy involved. The total number of incidences reflects differently for those numbers. For example 2 deputies may be involved in a hands on takedown but it is for the same incident.

For items 1&2:
We do not have a jail in Morgan County so the numbers are from regular patrol operations. Also, as stated in previous correspondence these numbers are from 2020-2023.

For items 3-6:
We have received many complaints by phone (verbal) but have not had any formal written complaints.

For item 7:
We only have one incident (fatal shooting) regarding one of our Sergeants. He was assisting another agency outside of Morgan County and this incident is not reflected in the attachment.

For item 8:
For 2022 we had a total of 6 incidences involving 7 individuals, one incident involved a husband and wife where the wife was arrested in her home while performing a federal arrest. The following are separated numbers by race:
4 white males
2 white females
1 hispanic male
