Pursuant to the West Virginia Freedom of Information Act and the West Virginia Open Governmental Proceedings Act, I hereby request the following records:

We are seeking the following records for the time period beginning January 1st, 2013 to July 13th, 2015. The following public information is requested:
- Copies of electronics recycling contracts
- Copies of Recyclers third part accreditation including: DEP Number, R2 Responsible Recycler Certification, e-Stewards Certification, Copy of Pollution Liability Insurance, Copy of Professional Liability Insurance (including data breach insurance), Surety Bond
- Copies of certificates of recycling, destruction and asset reporting received from Recyclers.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

On July 14, 2015, my office received pursuant to the West Virginia Freedom of Information Act ("W.Va. FOIA") a request for the following records:

1. "Copies of electronics recycling contracts"
2. "Copies of Recyclers third part accreditation including: DEP Number, R2 Responsible Recycler Certification, e-Stewards Certification, Copy of Pollution Liability Insurance, Copy of Professional Liability Insurance (including data breach insurance), Surety Bond"
3. "Copies of certificates of recycling, destruction and asset reporting received from Recyclers."

On July 14, 2015, my office received pursuant to the West Virginia Freedom of Information Act a request for the following records:

1. “Copies of electronics recycling contracts”
2. “Copies of Recyclers third part accreditation including: DEP Number, R2 Responsible Recycler Certification, e-Stewards Certification, Copy of Pollution Liability Insurance, Copy of Professional Liability Insurance (including data breach insurance), Surety Bond”
3. “Copies of certificates of recycling, destruction and asset reporting received from Recyclers.”
The time period for the request is January 1, 2013, to July 13, 2015. Previously on July 21, 2015, you were advised that additional time was needed to process your request. In further response, approximately 300 pages of responsive documents in an electronic format are available on a USB flash drive. Upon receipt of a check in the amount of $10.00 made payable to “West Virginia University” and sent to the “WVU Office of General Counsel, P.O. Box 9030, Morgantown, WV 26506-9030,” the USB flash drive containing the responsive documents will be mailed to the address provided for in your request. WVFOIA Procedure 1, Section 4.
Please note that regardless of the production of these or other related documents, West Virginia University reserves its right to exercise any and all applicable exemptions under W. Va. Code § 29B-1-4, privileges, or defenses, as appropriate. Further, as required by W. Va. Code § 29B-1-3(4),<http://www.legis.state.wv.us/wvcode/ChapterEntire.cfm?chap=29b&art=1&section=3> please be advised this request is now at an end.
