This letter is to acknowledge receipt of your Public Records Request 15-279 seeking:

As clarified: All 2014 email to and from Dr. Chuck Benbrook.

We hope to complete our review of a 1st installment of records responsive to your Public Records Request and respond to you by September 18, 2015, however, more time may be necessary.

Your request for WSU records is not confidential. All Public Records Requests are public records. The records responsive to a request may contain names, identifiers, or information about other people (such as employees, former employees, students, former students, or third parties). WSU may send a notice to people named in the records informing them that their name, identifiers, or other information about them will be disclosed under the Public Records Act and provide them sufficient time in which to seek legal counsel to determine whether to file a motion in Whitman County Superior Court to enjoin disclosure. When we send such notices to people named in records, we also provide a copy of the request with the notice.

The University charges fifteen cents a page for photocopies or to scan paper records to create a pdf in accordance with RCW 42.56.120, WAC 504-45-070(1), and WAC 44-14-07003.

In accordance with RCW 42.56.520, an agency may notify persons named in the record, or to whom the record pertains, of the request for disclosure and provide them with a copy of the Public Records Request. Named parties may contact the requestor to seek a revision to the request and/or seek an injunction from the Whitman County Superior Court to preclude production of the record. RCW 42.56.540. If such a motion is filed, as the records requestor you will most likely be joined as a party to the lawsuit. Burt v. Wash. State Dept. o Corr., 168 Wn.2d 828 (2010).

This letter is to advise you that WSU is sending notification to the party(ies) named in the records responsive to your Public Records Request 15-279 in order to provide time for the named party(ies) to evaluate whether to seek legal counsel and obtain an order to enjoin disclosure.

In order to provide the named party(ies) adequate time to evaluate whether to seek an injunction, we are extending the deadline for responding to your request. It is our intention to respond to your request on October 1, 2015, unless a lawful order to enjoin production is received by 5:00 p.m. September 30, 2015; however, more time may be necessary.
