All written communications with any of the following terms “avian influenza,” “bird flu,” “H5,” “H5N1,” and/or “HPAI” in the subject line or text that were sent or received by Minnesota Department of Health employees between March 1, 2024 and date of production of records responsive to this request.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

To aid in your determination of any fees related to this request, I am a journalist working for KFF Health News, a national nonprofit newsroom that covers health and health care in the United States and documents sought are of significant public interest. In the event that there are fees that exceed $100, please provide me a written cost estimate in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello Mr. Payne,

Your request is for public data. The 10-day statutory time limit only applies to requests from data subjects for data about themselves. As such, MDH is not statutorily obligated to respond to your request within 10 days.

Given the chosen keywords, you have made a request for a broad scope of data. The forensic pull for this request is a large amount of data. MDH has to review each piece of data to determine whether any of the responsive data are classified as not public so that the not public data can be redacted or withheld pursuant to law. As such, a significant amount of time and labor will be required to review and respond to you broad request. Given the volume of data, it will likely be a considerable amount of time to produce the response. If you are looking to receive the data more quickly, you can narrow the scope of your request. The narrower the scope, the less the volume of data to review. For example, identifying specific MDH employees whose correspondence you would like us to search, or providing more clarity or context about the subject matter of your request - for example, the correspondence containing the keywords that relate to a specific report, whether you only want the responsive data related to a specific action taken by MDH or related to a specific law that MDH carries out. It appears your latest response may have been sent in error or may have crossed in transit with an amendment/narrowing of the request I sent this morning. The amendment should read as follows:
