Pursuant to the New Mexico Inspection of Public Records Act, I hereby request the following documents:

All contracts (and their amendments) and memorandums of understanding entered into by the New Mexico Corrections Department for services and activities related to the New Mexico Women's Correctional Facility (https://www.cca.com/facilities/new-mexico-women-s-correctional-facility)

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Hello Ms. Earl,

I would like to revisit this request. Would a request reflecting the following language yield any additional responsive materials?

All contracts (and their amendments), memorandums of understanding, intergovernmental service agreements, and any agreements of any sort entered into by the New Mexico Corrections Department for all services, equipment, and activities involving/provided by/contracted for regarding the New Mexico Women's Correctional Facility and any facilities associated with it through any of the aforementioned agreements regarding the facility.

Responsive materials should include but not be limited to:

• the initial Invitation to Bid, Request for Proposal, or equivalent call for contractors
• the responsive materials provided by the winning bidder
• all other vendor responses
• all evaluation material, scorecards, reports, and notes generated in the selection process
• the current contract
• all exhibits
• all amendments
• all invoices/receipts detailing compensation received as a result of any agreements
• all agreements related to the provision of services, such as water, sewage, natural gas, garbage, etc.
• all financial agreements (such as loans or bonds) entered into as a result or in association with any of the aforementioned agreements
• all agreements, invoices, and related materials regarding the use of inmate labor by any of this agency's divisions or jurisdictions

This office received your August 26, 2015 Inspection of Public Records Act (IPRA) request, and is in the process of reviewing it. Pursuant to Section 14-2-8 (D) of IPRA, the Department will further respond to your request by September 9, 2015. The Department will indicate that you can inspect any responsive documents, and/or will provide an objection to all or part of your request, within fifteen (15) days (on or before September 9, 2015). However, if, pursuant to Section 14-2-10, the Department determines that it will need more time to comply with your request because it is excessively burdensome or broad, it will notify you of this fact on or before September 9, 2015, and also provide you with an estimate of how much additional time the Department will need to comply with your request.

Mr. Lipton:

Pursuant to your IPRA request of August 26, 2015, I am forwarding to you electronically at no charge, the copy of the CCA contract and amendments, along with the exhibits. This contract was initiated as a sole source contract in accordance with New Mexico law, and therefore there are no requests for proposals, proposals or responses, bids, evaluations or scoring material, or related documents. To the extent that the Department has any records detailing provision of services or financial agreements, that information would be contained in the attached contract. However, to be clear, the Department does not own or operate the Women's facility but only houses its female inmates there. CCA owns and operates that facility. Thus, the responsibility for providing water service, etc. and handling any bonds or loans regarding that facility would fall on and be handled by CCA.

As far as agreements pertaining to inmate labor at the Women's Facility, there are no such agreements. There are policies and procedure regarding inmate labor and compensation, but no separate agreements for the women to perform labor out of prison. There are also agreements for male inmates to perform highway cleanup work, but the women do not participate in this work. If you want copies of the relevant policies/procedures and of the highway work crew agreements, please let me know.

Finally, there are receipts and invoices detailing compensation received as a result of the CCA agreement, but these are in hard copy only, from September 2014 through June 2015. This office charges 25 cents per page, and there are 187 documents, for a total of $46.75. Please advise as to Whether you want these documents, and I will send an invoice. Once payment is received, I can send them to you via regular mail.

The Department has no other documents responsive to your request and has now fully responded to your request.
