Staff has informed me that the Police Department does not log potential violations using this ordinance. Instead, the person is charged based upon the statutory penalty for that potential violation.  For example, Public Drunkenness could be charged under Penal Code section 647(f), while Public Urination could be charged under Penal Code section 314.
Staff is able to pull data specific to those types of crimes, but we do need you to specify which topics you are seeking and the timeframe which would like these records.  For example, Public Urination for the calendar year of 2023 through present.
Staff is seeking further clarification as to what you mean by "acts of violence".
Lastly, staff did want to let you know that not every event listed in the ordinance automatically qualifies for a police report, absent additional events or circumstances.  For example, disturbing the peace complaints do not typically have a police report written.  However, if while investigating the complaint the officers find drugs, then a police report may be written.  Officers may also choose to issue citations for infractions, which will not result in a police report being written.
If you would like for the San Jose Police Department to proceed with your public information request, please provide clarifications within sixty-one (61) days from 06/24/2024. Otherwise, the San Jose Police Department will consider your request withdrawn.
