RE: PUBLIC RECORDS REQUEST of July 20, 2024., Reference # P003736-072024. Dear Matthew Petti, The Nebraska State Patrol received a public information request from you on July 20, 2024. Your request mentioned:
"All Advisories, Suspicious Activity Reports, Tips, Intelligence Briefs, Intel Reports, Leads Information or Data, Maps, Bulletins, BOLOs, and/or Joint Bulletins from 7 October 2023 to 14 October 2023 (inclusive) regarding an alleged pro-Hamas "day of jihad" or "day of rage." The Nebraska State Patrol is denying your request for the information regarding the matter referenced above. This denial is pursuant to Neb. Rev. Stat. § 84-712.05 subsection (5) because this information constitutes an investigative record. This denial is at the direction of Michael Wehling, Attorney III, for the Nebraska State Patrol. Additionally, the Nebraska Attorney General's office has opined that third-party requestors, such as yourself, are neither a Nebraska citizen nor interested person, and as such, your request for public records is not valid under Nebraska Revised Statute §84-712. You have administrative and judicial rights of review. If you believe you have been denied any rights granted by sections 84-712 to 84-712.03, you may elect, pursuant to section 84-712.03, to:
(1) File for speedy relief by writ of mandamus in the district court within whose jurisdiction the state, county, or political subdivision officer who has custody of the public record can be served; or
(2) Petition the Attorney General to review the matter to determine whether a record may be withheld from public inspection or whether the public body that is custodian of such record has otherwise failed to comply with such sections. Sincerely, Michael Wehling Attorney III
