You are advised, however, pursuant to the Nebraska State Patrol Policy and Procedures Manual (Chapter 6-07 Public Records Act) that there will be costs associated with the fulfillment of your public record request. The Nebraska State Patrol wanted to provide you with an estimated cost for the information you are requesting. Pursuant to Neb. Rev. Stat. 84-712(3)(f) since the estimated cost will likely exceed $50.00, you must pay the estimated fees before we begin fulfilling your request. We estimate that it will take approximately 48 hours to review the documentation. In accordance with Neb. Rev. Stat. 84-712(3)(c), the first 4 hours will not be charged. Therefore, the cost to complete your request would be 44 hours x $50.00 and hour, which would equal $2,200. estimated Our best estimate is that the review process will take approximately 3-4 months to complete. This is due to the fact that the records are so voluminous, and other duties require prioritization. In the case of a voluminous records request, the legislative history of LB 628 makes it clear that the custodian of the records may take whatever time is needed under the circumstances to prepare copies of the records at issue. Such a response time, for records requests such as “any and all records pertaining to” may be an “extremely long time.” Floor Debate on LB 628, 96 th Neb. Leg., 2nd Sess. 11294-11295 (Mar. 22, 2000) (Statements of Sens. Bruning and Brashear). Such a voluminous records request also does not require the custodian to abandon all other public duties in order to accommodate the request. Id. Should you wish to proceed further with your public record request at this time, payment of $2,200 will be required to be paid to the Nebraska State Patrol. The deposit can be made payable to the State of Nebraska and mailed to the Nebraska State Patrol, Legal Division, P.O. Box 94907, Lincoln, NE 68509.
