From: Emma Best

To Whom It May Concern:

Pursuant to the Nebraska Public Records Act, I hereby request the following records:

Copies of Memorandums of Understanding (MOUs), Memorandums of Agreement (MOAs), Non-Disclosure Agreements (NDAs) and other coordination, cooperation, or other resource or information sharing arrangements with federal, state or local agencies, specifically including but not limited to law enforcement agencies.

You may limit the scope of this request to documents generated between January 1, 2012 and the date of the processing of this request. If the most recent agreements (whether active or inactive) predate January 1, 2012, then I request a copy of the most recently applicable document.

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers in outlets such as Gizmodo, MuckRock, Motherboard, Property of the People, Unicorn Riot, and The Outline, among others. As such, as I have a reasonable expectation of publication and my editorial and writing skills are well established. In addition, I discuss and comment on the files online and make them available through non-profits such as the library Internet Archive and the journalist non-profit MuckRock, disseminating them to a large audience. While my research is not limited to this, a great deal of it, including this, focuses on the activities and attitudes of the government itself. As such, it is not necessary for me to demonstrate the relevance of this particular subject in advance.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 4 business days, as the statute requires.

Sincerely,

Emma Best

RE: PUBLIC RECORDS REQUEST of September 25, 2020, Reference # P000766-092520 Dear Ms. Best: The Nebraska State Patrol received a public information request from you on September 25, 2020. You are advised, however, pursuant to the Nebraska State Patrol Policy and Procedures Manual (Chapter 6-07 Public Records Act) that there will be costs associated with the fulfillment of your public record request.  The Nebraska State Patrol wanted to provide you with an estimated cost for the information you are requesting.  Pursuant to Neb. Rev. Stat. 84-712(3)(f) since the estimated cost will likely exceed $50.00, you must pay the estimated fees before we begin fulfilling your request. We estimate that it will take approximately 270 hours for clerk time to review the documentation.  In accordance with Neb. Rev. Stat. 84-712(3)(c), the first 4 hours will not be charged.  Any charges after that would be at the rate of $25.00 per one-half hour for clerk time.  Therefore, the time to review would be 266 hours x $50.00 which would equal $13,300.00. estimated For your convenience, you can access all State contracts on the following website, where you can also search by agency: https://statecontracts.nebraska.gov/ Our best estimate is that the review process will take approximately 90-120 days to complete.  This is due to the fact that the records are so voluminous. In the case of a voluminous records request, the legislative history of LB 628 makes it clear that the custodian of the records may take whatever time is needed under the circumstances to prepare copies of the records at issue. Such a response time, for records requests such as “any and all records pertaining to” may be an “extremely long time.” Floor Debate on LB 628, 96 th Neb. Leg., 2nd Sess. 11294-11295 (Mar. 22, 2000) (Statements of Sens. Bruning and Brashear). Such a voluminous records request also does not require the custodian to abandon all other public duties in order to accommodate the request. Id. Should you wish to proceed further with your public record request at this time, a deposit of $13,300.00 will be required to be paid to the Nebraska State Patrol for costs of initial review and possible redactions, the above-mentioned personnel time incurred to date (minus the initial four hours mentioned above). The deposit can be made payable to the State of Nebraska and mailed to the Nebraska State Patrol, Legal Division, P.O. Box 94907, Lincoln, NE 68509. Please note on your check the Public Records Number, P000766-092520. No additional actions will be taken in reference to your public records request until the initial deposit of has been received by the Nebraska State Patrol. $13,300.00 Please note that the Nebraska State Patrol will withhold all documents which are considered investigative, tactical, or intelligence information, pursuant to Neb. Rev. Stat. § 84-712.05 subsection (5). You have the right to modify or prioritize the items within your request within 10 business days of receipt of this letter. We are happy to discuss the options for narrowing, modifying, or prioritizing this request. You have administrative and judicial rights of review. If you believe you have been denied any rights granted by sections 84-712 to 84-712.03, you may elect, pursuant to section 84-712.03, to:
* File for speedy relief by writ of mandamus in the district court within whose jurisdiction the state, county, or political subdivision officer who has custody of the public record can be served; or Petition the Attorney General to review the matter to determine whether a record may be withheld from public inspection or whether the public body that is custodian of such record has otherwise failed to comply with such sections.
