All lists of books and periodicals banned in New Mexico prisons

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

This is in response to your IPRA request below dated August 9, 2017. The Office of General Counsel for the New Mexico Corrections Department (NMCD) has received your request and is in the process of reviewing it.
Pursuant to 14-2-8(D) of the IPRA, you will be provided with this agency's response, including whether the Department has any objections (based on exemptions provided in the IPRA), within 15 days of receipt of your request, on or before August 24, 2017.

However, pursuant to 14-2-10 of the IPRA if the Department determines that your request is excessively burdensome or broad, you will be notified within the timeframe noted above and provide you with an estimate of how much additional time will be needed to comply with your request. Thank you.

Pursuant to 14-2-10 of the IPRA the Department has determined that your request is excessively burdensome or broad. Your request will require well in excess of 15 days in which to comply. NMCD anticipates it will take 20 days or more to conduct a diligent search for the records responsive to your request. However once the records have been located and compiled, the Department will need to carefully review them to determine whether there are any exceptions or exemptions under the IPRA.

We anticipate being able to prepare the information and make it available for inspection and/or notify you of any exceptions or exemptions under the IPRA to your request by or on September 17, 2017. If that estimated date changes, we will let you know that information as soon as we know it. Thank you for your patience.

In response to your request regarding the lists of books and periodicals banned in New Mexico prisons, attached please find CD150200, which governs books and periodicals within NMCD. Please be advised that our policies can also be viewed through the NMCD website. There are no other documents responsive to your specific request-that is, the Department does not maintain a list of books and periodicals banned in New Mexico prisons. The Department utilizes the attached policy and procedure (subsection D.3. of CDE-150201) to determine whether a book or periodical should be prohibited.

The Department had previously indicated that it would provide a response to this request by or on September 17, and has now fully responded to your request.
