To clarify:

Does it mean a meaningful difference that perhaps all or most of this information has already been requested before though probably not in enumeration. Therefore, is it an act of production in producing documents that may have been requested before?

Sincerely,

Bailey Pillon

From: Bailey Pillon

To Whom It May Concern:

Please notify me of the appeals procedure here regarding this request, as applicable by law, procedure, policy, or otherwise.

I request that any records maintained in an electronic format be provided in that same format (such as a PDF, CSV, or XLS file), to avoid copying costs.

However, should you be unable to do so, I will reimburse you for the direct costs of copying these records (if you elect to charge for copying) plus postage. If you anticipate that these costs will exceed $25.00, or that the time needed to copy the records will delay their release, please contact me so that I can arrange to inspect the documents or decide which documents I wish to have copied. Please also provide an invoice and a cost breakdown of the fee estimate. If the fees are less than $25.00, please copy and send the records and invoice as soon as possible, and we will promptly pay the required costs.

The cost does seem reasonable as it seems rudimentary and a straightforward request to ask for such information. How many sworn officers are employed by NSB PD at the time you receive this email?

Sincerely,

Bailey Pillon

From: Bailey Pillon

To clarify:

I am adding a cap to the amount and requesting the reason or rationale for the seemingly excessive fees here as well as the appeals procedure. If all remains the same, I do hereby request that you contact me so that I can arrange to inspect the documents or decide which documents I wish to have copied, as I have mentioned.

Sincerely,

Bailey Pillon

Good morning, Ms. Pillon,

Thank you for your Public Records Request. This is a very large public request and an estimate is attached requiring an advance deposit of 100% of the estimated costs prior to beginning retrieval. The redaction process is labor extensive and per Florida State Statue 119.07 the home addresses, telephone numbers, dates of birth, and photographs of active or former sworn law enforcement personnel or of active or former civilian personnel employed by a law enforcement agency, are exempt from public record. Please make a check or money order payable to the City of New Smyrna Beach.

I have attached the City of New Smyrna Beach Public Records Request policy for your reference and review.

Additionally, what do you consider the most labor extensive aspects of the criteria I specified so that I may narrow it down further?

Good morning, Ms. Pillon,

Thank you for contacting the City Clerk’s Office. Your public records request, as listed below, is extensive. Per Florida State Statute 119.071<http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199/0119/0119.html>, the home addresses, telephone numbers, dates of birth, and photographs of active or former sworn law enforcement personnel or of active or former civilian personnel employed by a law enforcement agency are exempt from public record. These records must be redacted prior to public inspection. The Clerk’s Office is willing to work with you to narrow the scope of your public records request. It would be helpful if you would provide specific dates, email addresses, and any other search keywords.

Hi Sharon,

Please re-read the records I requested. It had nothing to do with requesting addresses or personal phone numbers of the officers of NSB PD. I didn't ask for DOB either. So, I have no idea where that came from and if it is meant as some sort of example or analogy, I really can't see the connection here. You are claiming that I am requesting records that I am not even requesting, and I did not mention those either explicitly or implicitly. If you mean that the same records I am requesting includes personal information that I don't not seek nor care to know, as I respect people's privacy, whether they are law enforcement or not - then I respectfully ask that this be escalated and I can be notified of the appeal process under law, policy, or otherwise.

I also still request that I can arrange a date and time to inspect the documents or decide which documents I wish to have copied.

Sincerely,

Bailey Pillon
