Under the provisions of the New York Freedom of Information Law, Article 6 of the Public Officers Law, I hereby request a copy, in Adobe Acrobat or other electronic form, of all records or portions thereof pertaining to, or containing the following:

1. Any and all contracts, memoranda of understanding, or any other agreement executed by the New York State Power Authority or any other state agency and 43 North LLC between January 1, 2013 and the present.

2. Any and all contracts, memoranda of understanding, or any other agreement executed between the New York State Power Authority or any other state agency and 43 North BPC Inc between January 1, 2013 and the present.

3. Any and all written or electronic communications produced between January 1, 2013 and the present discussing the founding, creation, or organization of 43 North LLC and 43 North BPC Inc.

4. Any and all written or electronic communications produced between January 1, 2013 and the present discussing the equity interest in winning businesses issued to 43 North pursuant to the contest terms. (See: http://www.43north.org/terms under "Equity Interest Award")

I understand that there is a fee of $0.25 per page for duplication of the records requested; however, the requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is not being made for commercial usage. As such, and as releasing this information is in the public interest, I ask that you waive any duplication fees.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

As you know, the Freedom of Information Law requires that an agency respond to a request within five (5) business days of receipt of such request. Therefore, I would appreciate a response as soon as possible.
If for any reason any portion of my request is denied, please inform me of the reason or reasons for the denial in writing and provide the name and address of the person or body to whom an appeal should be directed.

Ms. Feldman:

Thank you for your reply. Is there a reason why you cannot render a determination on this request until October 26th? As you know, the Freedom of Information Law requires an agency to respond requests within 20 business days. Two months seems like an overly long time to retrieve the records asked for in this relatively simple and straightforward request.
