To Whom It May Concern:
Pursuant to the New York Freedom of Information Law, I hereby request the following records:
Records relating to the total number of restaurants inspected for compliance with state pandemic air filtration and ventilating guidance.
Records relating to the total number of inspected restaurants that have installed MERV 13 filters.
Records relating to the total number of inspected restaurants that have installed portable filtration or UVGI instead of MERV 13 filters.
Records relating to the total number of inspected restaurants that were operating the installed filtration or UVGI systems when inspected.
Records relating to the total number of inspected restaurants that have other mitigation measures in place, when MERV 13 filtration, UVGI, and portable filtration, was not in place.
Records relating to the number restaurants that have been found to be or are currently out of compliance with air filtration and ventilating guidance.
Should no such records exist, I request information on what records and/or statistics are collected regarding air filtration and ventilating guidance enforcement.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

I think it's best to keep this discussion on-the-record, and not over the phone.
I am surprised that it may take an additional two months to retrieve this information. I would not have been surprised if it were to take another week or two to retrieve it. Disappointed, yes, but not entirely surprised. Can you elaborate further?
From: ALEXANDER RICCIO
I would like to mention that the state is currently experiencing uncontrolled exponential growth of the Delta variant, and nearly 9 million New Yorkers are yet to be adequately protected by vaccines. This is an urgent issue at this point.

In response to any FOIL request, this Office performs a diligent search for responsive documents. All potentially responsive records are reviewed for responsiveness, FOIL exemptions and legal privileges. This can be time-consuming. Please be assured we are processing your request as quickly and efficiently as possible. A response to your FOIL request will be forthcoming as soon as the process is complete.
Thank you for your patience.
