Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:
1. Any incentive packages or bids submitted by Empire State Development to Amazon, Inc. to induce the company to locate its second headquarters in New York State
2. Any incentive packages or bids submitted by Empire State Development to Amazon, Inc. to induce the company to locate its second headquarters in Western New York (Buffalo-Rochester region), the Syracuse region, the Albany region, and/or downstate (New York City-Westchester-Long Island region)
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

I write in response to your January 18, 2018 FOIL request for the following:
1. Any incentive packages or bids submitted by Empire State Development to Amazon, Inc. to induce the company to locate its second headquarters in New York State
2. Any incentive packages or bids submitted by Empire State Development to Amazon, Inc. to induce the company to locate its second headquarters in Western New York (Buffalo-Rochester region), the Syracuse region, the Albany region, and/or downstate (New York City-Westchester-Long Island region)
In response to item #1, we have withheld these records pursuant to section 87, subsection 2, subdivision (c) of FOIL, as they contain information that "if disclosed would impair present or imminent contract awards."
In response to item #2, please be advised ESD has no record responsive to your request.
