From: Benjamin Lesser
To Whom It May Concern:
Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:
A listing of every officer and/or employee of the agency, including name, office address, title and salary.
Per NEW YORK PUBLIC OFFICERS LAW, ARTICLE 6, Section 87(3)(b):
"Each agency shall maintain:
[....]
(b) a record setting forth the name, public office address, title and salary of every officer or employee of the agency."
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.
Sincerely,
Benjamin Lesser

Mr. Lesser,
I see that you received a five-day response on 12/29/14 that said, “The Office expects to either admit or deny your request, either in whole or in part, within 20 business days of today’s date.” It has not yet been 20 business days. Our Records Access Officers will be in touch as this date approaches. Thank you always for your patience.
Best,
Casey

Mr. Lesser,
I received this email from you this morning:
“This is a follow up to a previous request:
Hello —
Once again, per our records, the present request for the FOIL log maintained by OCFS has never been acknowledged or completed. Please advise.
Thank you.”
I have forwarded the response about FOIL 14-162 that I sent you on January 20. I see that you sent another email on January 21, but I thought maybe you had missed the one I sent you the day before since it references the same FOIL request. You’ll notice that I have sent this to all of the email addresses from which you have sent correspondence to make sure you receive this.
Thanks,
Casey

Hi Mr. Lesser,
The letter sent to you on January 28 indicated an extension of the response period for an additional 20 business days as we are still in the gathering and reviewing document phase of your FOIL request. Today marks ten business days. Our Records Access Officers will be in touch as the end of the extension period approaches.
Hope this helps. Thanks as always for your patience.
Best,
Casey

I just realized my typo – it’s a 60-day extension, not 20. I apologize for my error.
