Pursuant to the New York Freedom of Information Law, I hereby request the following records:
I am writing to request a copy of the settlement agreement between the Program Associates Organization and the Capital Region BOCES. The agenda for the April 17, 2023 Board of Education meeting indicates that the Board was asked to approve this settlement agreement, but no further information or cost details were provided.
As a member of the public, I am interested in understanding the nature and terms of this settlement agreement, as well as the costs associated with it. Please provide me with a copy of the settlement agreement, as well as any documents or communications related to the settlement agreement.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

In response to your FOIL request dated April 27, 2023, please find a copy of the settlement agreement between the Program Associates Organization and the Capital Region BOCES, along with documents related to the settlement agreement.
Please note that the pursuant to Public Officers Law § 87, the BOCES has withheld records constituting attorney client privilege; are inter-agency or intra-agency materials which are not statistical or factual tabulations or data, instructions to staff that affect the public, final agency policy or determinations, or external audits, including but not limited to audits performed by the comptroller and the federal government [Public Officers Law § 87(2)(g)]; or if disclosed would impair present or imminent contract awards or collective bargaining negotiations [Public Officers Law § 87(2)(c)].
You have the right to appeal any denial of access. Should you wish to file an appeal, you must file written notice with the Capital Region BOCES appeals officer, District Superintendent Anita Murphy, within 30 days.
