Please be advised that pursuant to Public Officers Law §89(3), your request fails to meet the requirement that the request be reasonably described and is therefore denied. Whether a request is reasonably described may be dependent upon the nature of an agency’s filing or record keeping system and agency employees are not required to engage in herculean or unreasonable efforts to locate records. The records you requested are not kept in a manner that would enable these records to be searched without extraordinary efforts. Specifically, in order to fulfill your request, it would require the agency to “engage in herculean efforts” to locate these records through a manual review of voluminous documents. See Konigsberg v. Coughlin, 68 N.Y.2d 245 (N.Y. 1986)

If you wish to submit a more specific request with additional information, such as names or email addresses of specific employees, we will review your new request and determine if the description is sufficient to locate any responsive records.

If you wish to file an appeal regarding this determination, you may do so within thirty (30) days from this correspondence by sending a written appeal to: Chief Safety Officer, Patrick Warren, MTA Headquarters, 2 Broadway, New York, NY 10004.

This FOIL will now be closed.
