An export of data from all tables of Universal Traffic Ticket (UTT) related data from New York’s Traffic Safety Law Enforcement and Disposition (TSLED) and Administrative Adjudication (AA) systems. We are requesting data starting in 2003 through the most recent year with full data availability in the TSLED and AA systems.
From our research we believe this data is collected by various New York State law enforcement agencies and processed with the Traffic and Criminal Software (TraCS). Furthermore, based on the New York State FFY 2024 - 2026 Triennial Highway Safety Plan [found here: https://www.nhtsa.gov/sites/nhtsa.gov/files/2023-10/NY_FY24HSP-tag.pdf] we have reason to believe that UTT data from TraCS is sent electronically to a central repository, maintained by the NYS ITS (Office of Information Technology Services) before being delivered from the repository to the NYS DMV. Furthermore, based on the Dec. '19 TraCS System Study [found here: http://fltrafficrecords.com/pdf/TraCS%20System%20Study%20-%20Final%20Report%20with%20Appendices.pdf] for the Florida Department of Transportation State Safety Office that New York State Police participated in, we believe that electronic UTT data was first collected via TraCS in 2003 and about 67% of all vehicle tickets given out in New York State are process through TraCS and in the TSLED and AA.

The lowest paid employee in my office capable of performing the query and search of the systems is a Grade 18, the hourly salary rate with fringe is $60.66. Pursuant to Public Officer’s Law §87(1)(c)(iv) the labor cost to complete the query and search of the files is $2669.04. Because of the considerable time this request requires, the Agency needs to be paid in advance for the work. If we have overestimated the amount of time this process will take, any overpayment will be refunded to you. If we have underestimated the time this process will take, we will notify you of the additional cost. Kindly forward payment in the amount of $2669.04 and we will process your request. If we do not receive payment by April 29, 2025, we will close our file on this request.

To Whom It May Concern,
My name is Adrian Nesta and I am the requester behind the request reference number R000393-021825 to the New York State Department of Motor Vehicles (NYS DMV). I am writing in search of further information about the $2,669.04 fee that was assessed to complete my request due to an estimated 44 hours of work a Grade 18 employee would be required to do in order to complete the request. Specifically, I'm looking for a more detailed explanation as to how the assessment of both the time period needed and the type of employee required to fulfill the request was determined.
From my understanding of 21 NYCRR PART 1401.8(c)(d) the NYS DMV's response indicates that the agency does have the ability to retrieve the data specified in my request but based on 21 NYCRR PART 1401.8(c) have determined that there is a cost associated with reproducing the data. According to 21 NYCRR PART 1401.8(c)(i) the NYS DMV has determined that reproduction cost is 44 hours of work for a Grade 18 employee and has informed me of said costs according to 21 NYCRR PART 1401.8(e).
My request is for the entire underlying Universal Traffic Ticket (UTT) data in the Traffic Safety Law Enforcement and Disposition (TSLED) and Administrative Adjudication (AA) systems. From my understanding this request should not require NYS DMV employee(s) to do extensive searching or querying for data beyond excluding columns/fields that need to be redacted due to privacy concerns and thus excluded. Most database programs have some kind of data export functionality that would enable straightforward data retrieval. Data can then be redacted afterwards to fit within privacy requirements related to the request. Alternatively, a relatively simple SELECT SQL query could accomplish a similar data export. My hope was that the data and documentation retrieval would fall under two hours of employee time and thus according to 21 NYCRR PART 1401.8(c)(i) not require a fee.
With more specific information about the estimated time frame needed to complete the request I will be able to potentially modify it in order to reduce the time or employee grade needed to fulfill the request and thus reduce or eliminate the associated fee.
