From: ALEXANDER RICCIO

To Whom It May Concern:

Pursuant to the New York Freedom of Information Law, I hereby request the following records:

Over the past year and a half, MTA officials have indicated to the public that subway cars have air exchange rate of up to 18 times per hour. Should this be the case, that would be fairly good.

Some measurement of my own indicates that this may only be the case part of the time, perhaps depending on system settings and modes.

I request records that support the claim that subway cars exchange air 18 times per hour. I request records that indicate this is the normal, common scenario.

Should it be available, I also request documentation that shows how often subway car HVAC systems are run in such a mode that exchanges air 18 times per hour.

Should there be no such documentation available, I request any other relevant supporting documentation, including internal discussions and measurements.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

ALEXANDER RICCIO

Dear Alexander Riccio:

Please be advised that your FOIL request for "records that support the claim that subway cars exchange air 18 times per hour and for documentation that shows how often subway car HVAC systems are run in such a mode that exchanges air 18 times per hour" requires clarification. We do not know what specific documents you are requesting. Merely requesting for blind documents that support a claim does not reasonably describe the records you seek. To that end, please provide a clarified request that reasonably describe the categories of information that you are seeking and cite the exact documents you seek within (five (5) business days to avoid administrative closure of this request.

Once you furnish this information, we can proceed with the processing of your request.

Do not administratively close this request! This is not a full time job for me, and I'd appreciate some leeway on your part given the delays on your part processing the initial request. I am aware though that this request does have some blind character to it. Since these claims were made by MTA officials in public without mention of the supporting documentation they were referencing, can you assist me in locating the types of documents that may be responsive?

What? No. It's clearly in the record that I responded before you closed the request. I feel like this was automated and incorrect.

From: ALEXANDER RICCIO

It appears my request (question #210716-000044) was incorrectly closed, and now I see why... It is neither of our faults. It appears the FOIL management platform that I'm using (muckrock) entirely inexplicably sent my 11/28/2021 communication (sent before you closed the request) to the destination "none", which is clearly some form of software bug. I'd appreciate it if you would reopen it.

The text of my 11/28/2021 communication that was sent into the void:

Dear Alexander Riccio:

This email shall acknowledge receipt of your attached letter, dated March 8, 2022, sent by way of Muckrock through U.S. Mail, and directed to the MTA.

Please be advised that your request was closed on November 29, 2021, as we did not receive from you a more clarified FOIL request. In response to your attached letter, please be advised that your FOIL request is not reasonably described and the information you provided is vague, unclear and insufficient for the purposes of locating and identifying the documents sought. To date, you have not submitted any clarifying details that would enable the MTA to reasonably process this request. As such, we are unable to respond and your request remains closed.

MTA FOIL Unit
*Please note: New York State Public Officers Law §89(3)(a) provides that a request must “reasonably describe” the records sought. When a FOIL request is made, the records sought must be described as clearly and specifically as possible. If the agency cannot identify and locate requested records with a reasonable amount of effort, it will not be able to assist with the request. While agencies strive to handle all FOIL requests in a customer-friendly fashion, the FOIL does not require the agency to conduct research, analyze data, or engage in herculean or unreasonable efforts in order to locate records or respond to a FOIL request.
