Pursuant to the New York Freedom of Information Law, I hereby request the following records:

I am looking for any papers relating to the Town of Hempstead's zoning regulations that might have anything to do with what is sometimes referred to as "exclusive zoning" i.e. regulations that had the effect (regardless of intent) of making it difficult for low income and/or African Americans from living in any of the communities that comprise the Town of Hempstead (not the village of Hempstead which is a part of the much larger town) between the years 1945-1985. The Town of Hempstead is located on Long Island in the State of New York.

I have called the Town Hall on numerous occasions and spoke to many people in various offices and got nowhere, so now I am filing a formal request for these records

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Good afternoon Charles,

I am appealing the integrity of the search for this request. We believe records responsive to this request can be generated as I am seeking zoning regulations, or records relating to zoning/housing policies, between 1945-1985, which are standard policy records that must have been recorded by the agency. In a conversation with Marie Jerome on 5/7/19, I explained that the scope of this request may be narrowed down a couple of years to best facilitate the search for responsive records. We understand that a 40-year span can be too broad of a scope. In addition, I also detailed that we would be ok with seeing records such as zoning regulations or other documents depicting zoning policies throughout that time period.

If there are still no responsive records after this appeal, we would appreciate an explanation in writing as to why these records are not found. We ask that another search be done on any and all of the town's existing historical databases. We will also mail this appeal to the address provided by the Town of Hempstead: Charles Kovit, Deputy
