Pursuant to the New York State Freedom of Information Law (1977 N.Y. Laws ch. 933), I hereby request the following records:

-All contracts with any internet service providers regarding the "proxying", "filtering", "blocking" or other means of censoring information, web pages and data being accessed by devices on NYCDOE wifi/internet networks.
-All emails with any internet service providers regarding the "proxying", "filtering", "blocking" or other means of censoring web pages and/or data being accessed by devices on NYCDOE wifi/internet networks.
-All emails between any companies regarding a certain site being blocked.
-Any financial records including payments in relation to internet filtering services or software.
-All other emails and attachments in relation to the NYCDOE internet filtering policies or services.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

To whom it may concern:

This letter is in response to the request for partial clarification by your office, made on November 7, 2017.

With respect to the entire request, I am clarifying the usage of the word “internet service provider” to be any company or organization that provides services in relation to the internet usage at any NYCDOE school or educational facility. You misinterpreted this as an internet provider.

With respect to item 2, 3 and 5 of my request, I am specifying both possible senders and recipients (dually) as Bill de Blasio, Peter J. Quinn, Carmen Farina, Christian Lawson, Stacey Abramson, Anne Roest, Barry Feddema, Leena Panchwagh, Ahalia Ramlogan, and Alton Webber. The keywords include: “filtering”, “censoring”, “blocking”, “withholding”, “blacklist”, “blacklisting”, “blocked”, “filtered”, “websense” , “forcepoint”, “raytheon” and “blacklisted”. The time frame I am specifying is January 1, 2012 to the present. These clarifications are in respect to all three of the items (2, 3 ,5).

With respect to item 4 of my request, the time frame is January 1, 2012 to the present. The entities I may be inquiring about include but are not limited to:

I would like to appeal these requests on the basis they have been constructively denied.

In regard to my request F13,911, I was informed I would be provided the records from May 31, 2017 through February 1, 2018 by March 27, 2018. Your agency has failed to deliver these records or provide me with an updated completion date within the legally mandated 20 days. The Committee on Open Government states that if an agency “has failed to grant access by the specific date given beyond twenty business days,” the appeal may be considered to be constructively denied. It has been 33 business days since March 27, 2018 at the time of this request, and therefore I appeal the denial.

In regard to request F13,390, I was informed that I would be provided a response by March 27, 2018. On the same ground as the above, I appeal this request as well.

Please provide acknowledgement of this request and the responsive materials forthwith. If such materials cannot be produced, please provide an appropriate explanation for this rejection, as is dictated by this agency's legal obligations under the New York Freedom of Information Law. Your accelerated attention to this matter will be greatly appreciated.
